I found this great document for the absences in UK for EEA. It basically states that because there is not way of checking if EEA person was outside UK, they way they approach it is by assuming a person was in uk unless showed otherwise. https://www.gov.uk/government/uploads/system/uploads/attachment...

Just to update you. Yep, a very well established solicitor confirmed that I can only apply after meeting the residency requirements (5 years of exercising the treaty rights). Dear Bonio, as far as I am aware if you are EEA, you would need to work for the 6 years. Just holding the PR status for 12 months is not enough..people I know of all had worked for 6 years previous to obtaining naturalisation. This is how I would understand the rules at least. Just one more thing, why you mention applying for PR? This is not necessary at all, once you have the status you do not need to fill EEA3 form.
