spent last two years under 3c, 3d. After permission to appeal to COA was refused , I didnt not go further and applied for ILR since i already completed 10 years.

Hi Khani, i think your GAP is classed as overstaying.. where there is no application with HO, so am I guessing it correct, that from the date you applied 1st time before your visa expiry date, and HO returned your application - you had application with them and thats why you should not count it towa...
