As answered before me, your lawyer is correct.

But just curious, in what thread did you read anything opposite?

Re: ILR postal applications (excluding SET(LR))

This is just a polite request to people who are phoning the Home Office for their application status before 6 months are passed. You are always going to get the same answer no matter how hard you try. And that answer is not likely to be satisfactory if you are trying to see when the decision is goin...

Sorry Somehow I think I was not clear in putting my question forward, I am still doubtful about this case and hence wanted to be even more descriptive as below. Baby Born in UK - Date 21 September 2014 .. Birth registered and abbreviated birth certificate obtained. Father ILR eligibility - October ...

Re: Bank account closed when in T1 entrepeneur visa ..ILR so

I cant say if your application is going to be affected or not but I believe you should sort out the fraud allegations with Lloyds bank before anything. Trying to open an account in a different bank will yield you nothing and wont make this fraud allegation go away (it would stay in your credit histo...

ILR Application - Sending Corrections

I have recently sent my ILR postal application and with that I sent my previous employer’s letter. Later on I realised there is a correction in that letter. They got my leaving date wrong, day and month are ok but instead of 2013 they put 2014 in it. So now I have got another letter with the correct...

Re: Visa Category for Dependent when I am apply for ILR

Your wife will be eligible for ILR through 5 year route. You cannot include her on your ILR application as a dependant as she is not eligible yet. You can apply to extend her visa as PBS dependant until she has accumulated 5 years of residence.

I thought I would mention this here (a bit off topic but worth noting). Trinity college guys are not accurate in giving info about the exam. In the exam I mentioned above, you have to prepare a topic of your own choice but be careful in selecting the topic. They wont accept any topic on an event whi...

Re: Tier 1 to ILR earnings - flight & hotel expenses inclusi

If the business expenses you get form part of your salary i.e. they were agreed in advance and are shown on your pay slip then yes you can include these. But if those were just one off or you got reimbursed for these expenses, then I am afraid they wont count towards your points. I was in the same s...

Re: Help ILR for daughter

Your daughter will be allowed in the UK as long as she would have a valid T1G dependant visa. You may be asked why she doesnt have ILR while the parents do but I dont think anyone would deny her the entry based on that.

Re: ILR dependant visa query

On SET(O), if you will be applying her visa as your dependent then you dont need to show her absences (they are irrelevant for that matter). You only need to show proof of cohabitation, provided she meets the criteria (2 years or 5 years rule). Edit: If she came in 2013, she'd have to meet 5 years c...

Re: Section 11L for SET(O) confusion

Bear in mind that you need to fill in this section only when your 5 years continuous residence is made up of Tier 1 General and any other category.
Its not applicable in case 5 years are spent under Tier 1 General and no other category.

Re: Help- Queries on Set (O) form for ILR

1) This question has been debated quite a few times. Search for it on the forums and decide what you want to do. Even if you have not been outside UK for more than 180 days, you still have to provide the evidence. 2) You only have to provide evidence if your consecutive 5 years period is not made up...

However, the onus is entirely upon you to know and assess your English language capabilities and then decided whether you want to learn English before taking a test or you have good enough kn...

Re: Very Confused! Please Help

Its pretty logical that only one application can be considered at one time. So if you apply ILR dependant then you must withdraw the naturalisation application first. In normal circumstances, when you send any visa application from within the UK then you have to stay in the UK while your application...
