Re: Short Visit

Thanks Vinny for your advise.

Do you see any difference if I apply for visitor visa now or if I come as a USA citizen without need to get a visa, 3 years later?

Any recommendations?

Re: Status Update- After Appeal Allowed

Home Office asked me for Fresh Third Party Letter. They give me 7 days to post it back. I received it when I had only 4 days left. (3 days already in post). My Third Party was overseas. I was lucky that they wrote the letter same day and found a lawyer to witness his signature and get the legal repr...

Re: Status Update- After Appeal Allowed

Dear HSO, I made a contact with my Local MP through E-Mail. He did not ask me for anything except Home Office reference number and date of last contact from them. He sent me a letter back from House of Commons with his name to tell me what actions have been done. He was really helpful. Home Office a...

What can I do after ages of waiting?

Dear All, I have got an awkward situation: 1- I applied on December 2012 for Tier 1 Entrepreneur while the rules had not been changed 2- I received a letter on February that the rules will change soon and they will communicate with me. 3- In March 2013 Application was refused on 3 points. I) Bank le...

Nine Days to Submit a letter

Hi... My appeal was allowed in FTT last Feb. Home Office tried to challenge it but their permission was refused in March. Since then there was no news from Home Office and they ignored my calls. I made a contact to my Local MP recently. On 12th they have sent me a letter which I received today (17th...

Re: Appeal allowed but HO appeal against the decison.

A recap on this thread will show the context of determination letter in words that I had written previously. Basically they refused my application on 3 points: 1- Third party letter was not signed by me 2- Third party bank letter does not include his phone number 3- The letter from legal representat...

Re: Appeal allowed but HO appeal against the decison.

Home Office can now apply from Upper Tribunal Directly for a permission to appeal. They need to Submit a new Ground of Appeal. In my case, FTT told Home Office, they can lodge a new appeal only if they have new points raised apart from subject of determination. As in FTT all the issues being discuss...

Re: Is it possible to HO to appeal in UT without my knowledg

They sometimes send their application to appeal against the decision late... Very late... Soon, you may reicive an acknowledgement that Home Office has applied to go to UTT and we will contact you in writing... Later on, a Judge in FTT will review grounds of Appeal submitted by Home Office. Then the...

Re: Appeal allowed but HO appeal against the decison.

That's pretty late! Court may refuse their application unless upon submission of Grounds of Appeal, they provide genuine reason for delay. Do not worry. Wait for the result of their application. Then if it was granted, speak to your solicitor, barrister. If you have a solid case, you will win UTT ea...

Re: any one got visa of evidential flexibility

That letter might help to point out but it can not be used as a solid evidence for foundation of the argument. In a court session we started to defend by that letter and judge was not interested. He did not also point it out in determination. But give it a try. Rodriguez, HO Policy and Immigration R...

Re: any one got visa of evidential flexibility

If the documents are genuinely missed and are not being listed at the time of decision, HO is not mandated to request documents but in the rest of cases it is still valid and if a part of information is missing or letters are made in incorrect formatting, based on Rodriguez, Immigration Rules and HO...

I think you had been lucky that HO has been communicating with you in regards to the missing information instead of refusing your application. In a lot of similar scenarios, applications have been rejected on demand. I strongly recommend you to seek a legal advise and prepare a contract that highlig...

Re: Please update status after HO challenged decision FTT.

Did you appeal based on Rodriguez? HO wants to bring an excuse that Rodriguez is overturned based on a recent case but it is actually leading them to loose most of their cases... Because Evidential Flexibility is still valid, However, courts are more into details to ensure that the documents were no...

Re: Please update status after HO challenged decision FTT.

I am sad to hear that but I am sure that it will end good. Even if you loose the case in UTT you still can make a fresh application. So maybe better to work on that and make a flawless case :)
Shah what happened to your case??
