Firstly gap would apply from the date of refusal not the visa expiry date. Secondly,u can overstay up to 28days since it is less than so it is disregarded hence no break in residence. Sorry I have not replied ur email yet, as I was quite upset and busy dealing my visa problem. But I got good news too, I got the visa approval letter, but my BRP card was lost in delivery. Sigh.

The ukcisa guidance is correct. You are misreading the tier 4 guidance.
