It is not that simple as you heard. Broadly, it is like this; To work in US, either you should have a permanent visa(green card) or a temporary worker visa(H visas/L visas) H visas are different kinds H-2A(agriculture workers), H-2b(temp. non-agriculture workers, like cooks, fishermen etc), H-1b(spe...

Like I said, H-1b does not have a problem with immigrant intent like F-1 does. So if she met all other requirements for H-1b, she would be given the visa at vietnam even if her GC is pending and she'd be able to enter. But if she changed status from F-1 to H-1b in US and then needed to travel to vie...

legelsegel,

Your contacts in US will have to find an employer who can sponsor you for a work visa (H visa mostly). The petition for that visa is filed in the US
and once approved, and you meet all other requirements for the visa,
getting it stamped at the embassy will be fine.

No point considering US citizenship since you have more than 4 years before you can apply for it. If you file for her now, she will get her GC in 4-5 years anyway. With a GC pending, she could avoid travel till she got her H-1b H-1b does not have any problems with immigrant intent, so she can reente...

Once you file a petition for her under 2nd family category after your marriage, she may have problems reentering after travel abroad on her F-1,since F-1 requires non-immigrant intent. If she can avoid travel, you can file for her after marriage and she can continue her F-1 to OPT to H-1 journey. Sh...

US does not have a point system for immigration. Mostly, you need sponsorship either by certain family members or an employer in the US. As a CA you could find an employer in the US who could sponsor you but the process may take years depending on which employment category you use. Or you could find...

H2B for new business

A permanent resident has just started a food service from home.
Is it possible for her to hire a cook from abroad on an H2b now?
Or is it only possible after the business has run for some time?

I am assuming you are a canadian citizen and your fiancee a US citizen. YOu did not mention any of that. Anyway, no way you may speed up the fiancee visa processing. If you want to save on time, money and hassle ,you could get married in canada and he could file for your immigrant visa in place of t...

I can tell you about the US part; You cannot get a green card based on marriage on your own. Your US citizen spouse will have to file a petition for your immigrant visa after you get married. Mostly, US citizens file such petitions in the US but since you do not wish to move to US yet, and she is mo...

To moderator; overstay

I overstayed my visitor visa more than 10 yrs ago. I got another
visitor visa recently by convincing the consular about the reason for
my overstay. Do you think I will face any problems at the port of entry?
