Re: Proving ties to which country?

The aim of showing strong ties is to show that they will go back to their country. If they can show strong ties to either country the better but please dont forget the letter that indicates your cousin is on leave for 1 month and will be expected to work after the month is over. He is self-employed....

Re: Your visa application @ Abu Dhabi (Ref:1234567)

Good to see the thread is having a lot more informations now. I just read all the unread posts since last visit and want to share few other things which are still under discussion. There is still one question that what is the email if refused. From my experience: You will not get any email at all, ...

Re: Proving ties to which country?

It is a good start but i am not certain it will be enough thou. Can he show strong ties to Pakistan? He would be able to provide property documents and bank account details in Pakistan and also would be able so show family ties. Should he send these documents as well and would this not confuse them ...

Re: Proving ties to which country?

UAE does not give citizenship to foreigners and he does not own any property there, instead he rents. His family resides in Pakistan but he does not support them as they are well off. The only way I can think of proving ties to the country is through his job and bank account but would this be suffic...

Proving ties to which country?

I want to sponsor my cousin from Abu Dhabi UAE to come to the UK for one month whilst he's off work in the summer. He has lived and worked in Abu Dhabi all his life and holds a Pakistani passport. Which documents do we need show that would be sufficient enough to prove that he will go back and for w...

Re: Court fees refunded before hearing

It sounds like they've changed their mind and no longer want to hear your case. When appealing if they decide to not hear your case they will not take your fee is what I've been told.

Re: Detention by the UKBA ???

There isnt a specific time frame but they could knock on your door anytime or even worse still personally hand you the refusal and take you to the removal centre. We were worried about this when we got the refusal letter from UKBA refusing my wifes leave to remain application due to not applying in...

Re: Overstayed Spouse Visa - advice required

Well good luck. You can still apply for SET(M) again after the appeal outcome so far as you meet B1 English and LIUK. You may also ask the UKVI for the passport back in order to sit LIUK. Thanks. If the appeal is a success they will return her passport back although I will try and request UKVI to r...

Re: Overstayed Spouse Visa - advice required

My wife doesn't have a drivers licence or a provisional, she only had her passport to use as ID. We've decided to take the second solicitors advice and lodge an appeal using further evidence to show why I cannot move to Pakistan. Our appeal would be under human rights as they have not fully consider...

Re: Overstayed Spouse Visa - advice required

SET(M) doesn't require extant leave therefore it doesn't matter if spouse leave has expired! Apply for SET(M) and get the B1 English and LIUK completed. Hi Amber, I wish I could follow your advice but I have three issues I was hoping someone could address. 1. Home Office has retained my wife's pass...

Re: Overstayed Spouse Visa - advice required

Given the strength of your solicitors' belief in your chances - ask him to work on a no-win-no-fee basis and see what his response is. I, personally, do not believe you have a huge chance. As long as UKBA considered you in the process properly (which they appear to have from what you've posted!) I ...

Re: Overstayed Spouse Visa - advice required

A JR isn't an appeal. It's an opportunity to challenge the lawfulness of the way the decision was made. Unless you believe that UKBA made some sort of unlawful step in their decision making process - you have no grounds for a JR. See here: http://www.judiciary.gov.uk/you-and-the-judiciary/judicial-...

Re: Overstayed Spouse Visa - advice required

The solicitor stated that I have a good case for judicial review based on my ties with this country. My wife has been asked to leave the country and to contact the enforcement agency for removal. Assuming she passes the KOLL requirements and I applied for SETM, surely this would be refused also due ...

Re: Overstayed Spouse Visa - advice required

I consulted a solicitor and he decided it was best I apply for FLRM even though its likely it will be refused as it was unlikely she would obtain the KOLL requirements soon. He sent the application off with reasons for delay but home office did not by the reasons for not applying in time. Since ther...

Re: Overstayed Spouse Visa - advice required

I have read that post before posting my own thread for advice. I feel she will not be able to meet the requirements for ILR any time soon in two year may be. My only option as it stands is to apply for FLRM even though it may get refused or she will have to go back and apply again. If I explain to t...

Overstayed Spouse Visa - advice required

My wife came to the UK in 2011. I later enrolled her onto to Esol classes to meet the requirements for ILR however due to her english not being very great and the change to ILR requirements over the course of the two years she was unable to meet the requirements. When she applied for the Spouse Visa...
