As per my understanding the clock is gone back to zero for the time spent in uk as your dependant and she will have to apply for dependant of settled person and will be eligible for ILR after 5 years. I think lawyer is right bcz if u r more than 28 days than it will be a problem so the best solution apply for another category and than vary the application to lr. Hi CKP, If you and ur wife both are eligible for SET (LR) by end of this year then go for Long residency as there are very little requirements for this visa as compare to others. Hi Allwell46, Your wife was on a PBS dependent status prior to 09th July 2012, hence she is covered by the old rules. Means to say she has already spend her qualifying time for ILR as point based system dependent, so once she gets her FLR(M) visa and biometric card, she is open to apply for her ILR...
