I do not think so as you would have valid leave when you return to UK. Check with UKVI helpline as well for peace of mind.

Logically, you should not be paying IHS twice but the question is whether the online IHS paying system is smart enough to detect this and adjust the amount?

I believe you will might have to pay and then you can claim a refund. The best is to contact UKVI for this question.

My son does need a dependent visa as he will be travelling outside UK in coming months. He will not be eligible for British Passport unless I get ILR.

I think your solicitor should raise this query to UKVI team as well as only UKVI can confirm how to pay for this amount. They would probably ask you to pay at visa application centre when you will go to submit passport.

HI Janinah,

Your understanding is correct. In order to apply for Tier 2 visa, the job needs to be at NQF 6 level. Switching from PSW to Tier 2 only exempt the employer from carrying out resident labour market test.

You will have 60 days from the date UKVI issue you a curtailment letter. They usually take around a month or 2 to send this curtailment letter out so hopefully you have around 3 months legally in UK.
