I sent a reconsideration request last month pointing them towards these facts and the discretion point above. Waiting for reply now...

The way it is formulated in the guidance, discretion has to be applied if conditions stated are met! It is now a question whether those conditions are met or not!? Do you guys agree that they are? if so..What would be the best way to apply for a reconsideration and how to go about it? Should I do it...

It seems to me that the Home Office is not recognising the appeal you filed against the FLR(FP) rejection as constituting Section 3C leave. How did you appeal the decision? I got a call from my solicitor today with the good news.
Al Hamdoulillah!
I been granted ILR, my documents are back, and will be waiting for the bio card over the next few days.
