Is there any threshold (e.g 180 days) for dependent applying for ilr? I will be applying for ilr SET O n my wife as my dependent, She has lived outside uk more than 90 days this year (last 4 years she has been in uk throughout). Can you confirm if this 90 days absence is going to be a problem for her?

Also can you please clarify about 180 continuous residence rule it is for main applicant only. But what if the spouse has stayed 90+ or 180+ days outside UK in a single year, is that going to cause any problem?

Hello Members,

Can you please confirm how many days Tier-1 General can stay outside UK without breaking ‘Continuous Residence’ requirement for ILR?

Also how can we prove our presence/absence in the UK, what supporting documents we need to present?

Lets say if parents (and child born in UK) everyones current Tier-1 leave expire on Nov 2014..Than parents apply for ILR in Nov 2014 but child doesnt...would this make the child over stayer or immigration status illegal as his tier-1 dependent is now expired as his parents didnt include him on there...
