New US citizen born in UK

Hi, my American wife and I just had a baby in London. He is a US citizen (his mother lived in the US well over 5 years after the age of 14). I would be grateful if someone could help with the following questions: 1. How many copies of our marriage certificate do we need in order to apply for US cons...

Re: EEA Family Permit application

Everywhere in the world as long as the applicant has the right to stay legally in that country for all the time of the application (even on a tourist visa or stamp). Thanks. The reason I ask is that when I married my American wife in 2005, we chose to get married in the US rather than Italy, since ...

EEA Family Permit application

Does an EEA Family Permit application need to be submitted in the applicant's country of residence, or can it be done in a third country? E.g. can a US citizen living in the US who marries an EU citizen in France apply in France, or do they have to go back to the US in order to apply?

Thanks,
Marco

Is your wife an EU citizen?
She is a US national on an EEA family permit (permanent resident card).

Letter from employer

My wife is about to submit her naturalisation application form. As proof of residence, she is going to include a letter from her employer with a wording like the following: "This is to confirm that Ms Jane Soandso (DOB: 01/01/1980) of ..., London, has been employed by Acme Ltd on a full time an...

I disagree with the above advice. I suggest you apply for ESTA, declaring the previous visa denial. If your application for ESTA is denied, then you'll need to apply for a visa.

Re: urgent question regarding six month validity of passport

I don't know the answer to your specific problem, but my advice is to post on the following forum, which has higher traffic, and whose users include some US immigration lawyers:

Good luck.

Thanks for your reply. Yes, the parents have both been working in the UK for several years, so they were both exercising treaty rights for over 5 years before the baby's birth. They can actually apply for naturalisation themselves, but my understanding is that they are not interested. Thanks again.

Proof of British citizenship

A couple of friends of mine had a son in 2009. When the son was born, both parents, who are EU citizens, had been living in the UK for well over 5 years, hence they were both permanent residents in the UK. My understanding is that this makes the son a British citizen. Is this correct? If so, is ther...

Re: US Immigration

You cannot transfer your B1/B2 visa from passport of one nationality to passport of another nationality. Transfer from same nationality passports is possible (fees $160 applies) or you can carry your old/expired passport with visa along with new valid one. No it's not, not for B visas anyway. The o...

Thanks for the reply . I still cannot by the fact that if you already have a valid visa ( 2017 my case ) which benefit me to use 6 months on a single stay as VWP is 3 months ( only reason to transfer ) . Is it documented anywhere that change of nationality , voids all your previous valid visas on a...

The refusal should be disclosed, obviously. Not doing so might well constitute misrepresentation, a consequence of which can be a lifetime ban.

Re: Can Permanent Resident status be revoked after divorce?

Hi, in answer to your questions: 1. Yes, this is correct. 2. Under no circumstances. 3. You don't need to do anything. Your wife could claim that your marriage was a sham, but that's unlikely, since it would imply that she was an accomplice in immigration fraud. I wouldn't worry about it. By the way...

So I am wondering: Do I need some sort of Visa to Photograph the wedding? We'll be staying in Hawaii for a total of 7 days. We are not &quo...

Re: Spousal visa: could it be denied in my case?

It is illegal to enter the US as a tourist with the intention of adjusting status to permanent resident. You should apply for an immigrant visa beforehand. Unfortunately, the process takes much longer than a month. If you enter as a tourist and try to adjust status, you might get away with it, or yo...

Was this in the EU line? (I would be surprised if it was). Did they ask British passport holders to do the same? She should not be treated differently. Yes, my wife was in the EU line with me. Another experience at Heathrow

On 9 April my wife and I had another "interesting" experience at Heathrow. This time the immigration officer did not ask my wife - who has a PR sticker in her passport, as the wife of an EU citizen - for her landing card, and did not stamp her passport. Howerver, the immigration officer as...
