You don't pay surcharge for ILR, but dependant using FLR M will need to.

Smir my appeal was also allowed based on the additional ground of completing 10 years and he should be able to vary as long as the judge didn't state he should be issue with a particular type of leave.

if you are sure you meet all the requirement, you can withdraw from the appeal and go for same day service after you receive confirmation from tribunal.
