Just a quick update. My previous post was following a telephone conversation with my mother once she arrived at the airport. My mothers visa is a standard multiple entry 5 year visa, with a maximum stay of 6 months (180 days). She arrived with a confirmed 6 month return flight ticket. Today on arriv...

Visitor visa for less than 6 months

My mother holds a 5 year multiple entry visitor visa to the UK. She spent 5 months between March-July 2006 in the Uk and travelled to the US. She returned to the UK in Dec 2006 and returned back to India in Jan 2007. Due to unforseen circumstances she needed to come back to the UK to see us. She arr...

Thanks JAJ, I should have clarified. We both are applying for naturalisation. We both have to prove residential requirements and hence have to submit our passports. I agree that employer letters will add more weightage to the residence requirement (if employed for 5 years or over). In my case, I can...

After all, why did the Government introduce HSMP at all? To give a route to highly qualified people to work in the UK without needing a WP. If NHS Trusts are ignorant about the way an HSMP extension is easy to achieve for someone who is working, then surely some education of NHS Trusts needed. John...

John, Not sure I am understanding the point? Are you saying that some posts are fixed term and if the person does not have LTR of that length they are not getting appointed Precisely! As of today, following HSMP approval, an individual gets 2 year LTR, followed by 3 years after showing suitable econ...

Thanks aboudi and John. I checked about this as well and clearly they have a right to work. But what about the HSMP individuals not considered to have a right to work if the job is question is longer than their LTR? I'm fairly sure that HSMP approved individuals using this forum would have been offe...

This job is unlikely to attract a work permit. Applications from candidates who require a permit to work in the UK may not be considered if there are a sufficient number of other suitable candidates. Certainly discriminatory, but given the legitimacy of the immigration rules, it is considered fair....

The issue with HSMP and employment of doctors is now clear. Please see the following guidance: http://www.nhsemployers.org/workforce/workforce-723.cfm#question513 An HSMP visa holder will only be considered in par with UK/EEA applicant to be employed in a NHS training job if his/her current leave to...

Thanks Cool and sushdmehta, We are aware of the NHS employers website and their FAQ section. Nonetheless, the trusts are intrepreting the rules as they wish and certainly have rejected a number of candiates who had already been through a step1 selection process in the GP training scheme. We are wait...

Interpretation of HSMP regulations

As you may be aware, new immigration regulations have been introduced for overseas doctors in training, so as to require workpermit to work in the NHS. Some doctors may be exempt from workpermit, such as HSMP or dependents, to be able to secure a job. However, a number of NHS trusts, when considerin...

Sher, How long does your friend want to bring her in-laws to the UK? The usual option most people take is to apply for a family visitor visa for the grandparents (after your friend comest into the UK) so that at least they get 6 months visa to stay with their grandchild. Is that not an option? Moder...

If the case worker guidance lists the pre-registration house officer post as graduate experience, so is the internship. Sometimes, an internship is also undertaken...

Stedman, I totally agree with the fact that it is difficult to prove that discrimination is taking place unless one can bug the interview room. The real truth is that no nonEEA doctor will ever get to the interview room in the first instance. The latest job advert for the Anaesthesia Specialist Regi...

John, Of couse HSMP will be the best status to have (THEORITCALLY) to secure a training job. However, many NHS trusts are interpreting the new immigration rules as they wish. Many trusts are now only considering applications from UK/EEA nationals first before even considering other nonEU doctors who...

I'm amazed by the insensitive comments made by webhunter and mhunjn. The new immigration rules certainly spell doom for thousands of non-EU doctors currently in the NHS training system. The fact that a doctor in a training grade in the NHS is now said to be in "employment" happened overnig...

Thanks Paul. The application form per se[ "SET (O)"] has no reference to this guidance about applying within 28 days of leave expiry. It only mentions the 28day rule for completing the qualifying period. I only happened to see it in the PEO pages of the website. Hypothetically consider som...
