Also if possible can someone help understand what impact this new guidance will have on my ILR application? Its a 8.5 yr old offense and was declared twice previously for Tier 2 related applications as well.

No, they continue to extend their PBS Dependent visas until they meet the requirements for ILR. All assuming the rules remain the same. No need to switch to 'family of settled person' visa. Are non custodial sentences not factored in for spouse visas?

S.EC 1.5 does have the same clause as 320(18A) for non-custodial sentences - the 12 month period from the date of conviction for discretionary refusal.

Thank you for your replies. I went through the refusal clauses that would be pertinent for spouse visa.

But just curious. If I were to apply for a work visa how would the above mentioned refusal clauses be construed ?
