Appendix FM : self-employment evidence

Hi can I just ask a question about evidence for self-employment... Does one have to prove one's self-employment income through payment entries into a bank account ie on bank statements ie during the April - April tax year? What if you were paid cash and did not necessarily put all your income into t...

EEA PR - pregnancy

Hi can anyone answer this question? If you are trying to get permanent residence for 5 years continuity but for one year you were pregnant and off work (left the compamy altogether), then will this break continuity? I am aware there is a rule saying you can be absent from the UK for up to a year for...

T2G question

Hi I am presently on T2G with CoS expiring 31/7/15. I am changing employer (but with same SOC) and have been assigned new CoS starting on 17/8/15. My present T2G leave is valid until 15/8/15.
Is it a problem that there is a gap between the dates of my CoS's ie 31/7 - 15/8 ?
Thanks

Tier 2 (General) Extension query

Hi I am just about to attend a Tier 2 premium service appt on 20/6/15. Have already paid £600 IHS. Just want to check my application will be OK if that is possible as its a lot of money to waste! I arrived in the UK on a Tier 2 (General) visa on 5/11/2011 (valid from 27/10/2011 - 30/09/2012) I exten...

Re: SET(M) (2yr) - Rejected (wrong ESOL sent by accident)

Obie - no the refusal letter specifically stated no appeal rights. They also rejected the reconsideration and said can only do new application. Looks like its a case of sueing the immigration agent? CR001 - No this is a different case, although similar. But can I ask - is it still the case that if y...

SET(M) (2yr) - Rejected (wrong ESOL sent by accident)

Hi can anyone help with the following: an ordinary SET(M) application was put in under the old rules (after 2 year probationary period). An inexperienced caseworker put in an ESOL level 2 by accident. The person had a level 3 ESOL but it was not included. The Home Office refused for not satisfying t...

Re: Overstayed 2yr spouse prob period-can i apply for ILR?

Hi Obie, Vinny or anyone else. Thank you for your previous advice which confirmed it would be OK to apply for ILR even though one had overstayed one's spouse visa (having completed the two year probationary period): Refer to A280(c) and 288 and judgment . In light of all the recent changes in immigr...

Re: Incorrect ILE endorsement for spouse visa

Sorry did not read your second sentence. Yes it's possible to try to ask UKVI for confirmation in writing that ILE remains valid but as the person in your thread found out, bringing it to their attention could lead to a correction downgrade if they choose to ignore their own guidance. But point take...

Re: Incorrect ILE endorsement for spouse visa

That's brilliant. Thanks so much Vinny for that info. Really useful. It would seem like the Home Office arguably have no power to revoke the ILE but if brought to their attention they will! So maybe best to keep under wraps and not apply for a transfer of conditions into a new passport and keep the ...

Incorrect ILE endorsement for spouse visa

I have a friend who recently applied for a spouse visa from abroad and got given a stamp of ILE in their passport (instead of 2 1/2 yrs limited leave). Is this decision permanent or can it be revoked/amended if discovered? Would it be advisable to contact the Embassy or no bother?

How strict are the Home Office or Passport Office with this (if trying to prove PR befo...

Worker Registration Scheme and Permanent Residence Question

Hi, a question about the Worker Registration System (WRS)... What is the situation if you registered with the WRS and got a WR Certificate for your first employer but then you changed employer and did not re-register to get a new WR Certificate? Are you still legal? As far as I can see from the Regu...

Cannot afford health surcharge

Hi can anyone advise on the following: When one applies for a FLR(FP) on the basis of family life there is an option to also apply for a fee waiver on an Appendix 1 form to avoid the £649 fee. If one cannot afford the £649 then one cannot afford the £500 surcharge also now required. However it is re...

Where to lodge a reconsideration request (Manila ECO)

Should it be at the British Embassy, Manila directly? The original visa application was lodged with VSF Tokyo Visa Application...

Appendix FM - Ongoing employment

A question in relation to the Appendix FM financial requirement for spouses... If someone is trying to prove they meet the requirement through self- employment i.e by having a profit of more than £18,600 in the last tax year, there is a requirement that they show "ongoing SELF-employment at the...

Re: Overtime counted towards "gross annual salary"?

Hi Helping Hand. Thanks for your reply. Yes that is the case if one is using Category A i.e. working out over 6 months but you need to have been in the same employment for 6 months for this and that is not this case in this instance. This person had a job for about 10 months, but is now just startin...

Overtime counted towards "gross annual salary"?

Hi I was wondering if anyone had a view on the following. I say that because the rules do not appear to specify, but perhaps someone can say something from case experience. I know someone who is soon about to make an FLR(M) application and trying to meet the financial requirement under Category B (1...

Many thanks for your reply SoHopeful. It's good to get confirmation. Re: Appendix FM 6 month rule - two jobs OK?

I see that this question has been asked before... Having been through various posts the conclusion I have gleaned is that it WOULD be possible to meet the Appendix FM financial requirement in Category A (6 months) if the sponsor was working two jobs, PROVIDING that the sponsor had been in each indiv...

Appendix FM 6 month rule - two jobs OK?

Hi just a quick question about the Appendix FM 6 month rule. It says that a person can meet the requirement if they work for the same employer over a continual 6 month period and keep above the £18,600 for each month (or if non-salaried their average over the 6 months exceeds the equivalent of £18,6...
