Feeling quite disappointed. My MP has gotten back to me and said that the issue was with the evidence of my 5 years of EU treaty right (but not exactly what evidence), which the caseworker on the phone told me it was with not having a 6th year of treaty rights (when I only need 5 as I am married to ...
Thanks for the kind comments. I sent my reconsideration with a special delivery envelope, so I'll know as soon as something is being sent to me. I feel like that was a silly move on my part as I keep checking the tracking online every 5 minutes! haha. Nothing yet but all fingers crossed that it's a ...
Did you claim the study period as part of your EU treaty rights exercise (in that section), or did you only list work for the six years? If you listed the study period, I am guessing that because it was listed, they are treating your six years as being 2007-2013, which is why this is required. I don...
Fair enough. I'll let my mp do that one phone call he said he could do (sometime next week I imagine), but other than that, I will just wait with all fingers crossed.
Payment has been taken. :) Not sure if I should be doing other things to try to push my case, or if this would cross the line from being polite to hassling. What is everyone's thoughts? I've sent the letter and contacted my MP, but I guess other additional options could be to: 1 - email the national...
Payment on my reconsideration hasn't come out yet. I never got the refund from the original app (thought it might come separately), but I am not too fussed as long as it is a 'yes' this time! Hoping the payment will be taken soon. The last few reconsiderations here appear to have only taken 3 weeks ...
Leaving the country for a two month period is not an issue as you only break your treaty rights if you are gone for 6 months or more. The issue here I think has come with the self sufficiency period. You could effectively write off 5 months 29 days as unnecessary I think (October-March), but from th...
Just to add my case here. I applied in October and was rejected this month. Since I wasn't quite sure why based on the reason on paper, the HO phoned me to explain the reason a bit more clearly, and it was because I had not provided a 6th year in the UK. I am an EU citizen, married to a Brit (and as...
I'm not sure if it was the caseworker or not (I assume so - didn't catch the name), but it was somebody who did know my case. Yeah in hindsight I probably should have said something, but I didn't want to risk being rude or catching anyone out! He was explaining very politely and I was worried just g...
Updating my timeline. Hoping for good news and that the agony all ends soon. Eligibility criteria: EU treaty rights + marriage to BC (5 years in total) Language: UK degrees Current nationality: EU Method of application: NCS Date of application: 20/10/14 Payment method: Credit card Date of receipt by...
Home Office phoned me and explained that the reason for my rejection was that I didn't prove a sixth year in the UK. Thus it became clear that the issue was that they expected me to have the extra 1 year under PR after 5 years of treaty rights exercise (which they said was all in order and accepted)...

I spoke to a lawyer who could see no issue. The only thing we thought of was that for a couple short self sufficiency periods, NCS did not want to send in my bank statements for them because they said it was too short to make a difference - they were essentially 'bridging' periods between two employ...

I phoned the HO. They said they will try to get me more info and phone me back within 48 hours. The person I spoke to agreed it was vague in an area that is normally straightforward, and he said he'll try to get more details for me. Fingers crossed. Feeling so discouraged.
I hope they supply you with more information, I don't think all caseworkers know all the laws, i think if they deal with EU cases then they are more learned in that than UK rule and maybe if they deal with naturalisation cases they know more about that than EU rules, the more reason why I think peo...
Yeah, I am going to phone tomorrow first thing and see if I can speak to them. Need to make sure the reconsideration letter addresses the exact point that caused the issue for them if I am to have any hope (and see if any letters requesting info were sent that I did not get). I have very little hope...
There's no time limit on the marriage. I did wonder if they didn't notice the marriage and thus were expecting six years, but their letter says I am being rejected for not exercising treaty rights for five years, no mention of six (though it says it elsewhere in the letter, seems generic though). It...
The treaty section does not ask for absences - it asks for the basis you are in the UK for the last five years. How would you fill in absences there when it does not ask for them nor provides space for them? From an absence perspective, it works differently than residence in that they only care if y...
Yeah - I proved the treaty rights for five years, just not technically the absences for the first two years as that was under the residency section instead. (Well, I did prove the absences, they just had a wee line over the first two years' worth as requested by the NCS person.) In the EU/treaty rig...
Yeah, that does seem like the wise way of going about it. I will phone them to see if I somehow get transferred to the case worker and am able to instantly get it all cleared up... Wonder what the success rate of reconsiderations is. Interesting to note that in the only other couple posts I've found...
