Re: EEA citizen just need to be present for 5 years or to wo

You should be fine then, but I would set it all out really clearly, and with very clear evidence, as to how you met each treaty rights exercise type and over which time period, and which documents you are providing to prove it.

Re: UK passport to UK born Polish girl

I would get a letter from Poland showing you are covered, but yes, you can also try to go for the jobseeker route for those early days rather than self-sufficient.

Has it not been 5 years since WRS finished anyway? So regardless of that, by now he'd have gotten PR.

Re: February application refused

What five years did you choose as the five years to get the PR, and how long was the jobseeker time period for? Here is what to do: Phone the home office, explain your decline, and explain you don't know where you went wrong. Ask for a more specific reason for how you did not get the five years cont...

Re: Help: Apply based on ILR or PR and when?

Option a would be the easiest and most straightforward. I would then go for option B for yourself and get your citizenship too, based on having 5 years in the UK. Count the exact number of (full) days you were gone in 2009 because if it doesn't hit 180, you can apply as you'll have five years of con...

Re: February application refused

As long as the five years of continuous treaty rights exercise has been met, you'll be able to get this sorted via reconsideration. How did your husband exercise treaty rights for five years? Please list all of the different ways he exercised treaty rights for the qualifying five years. Since you me...

Re: EEA citizen but permanent residency broken for 13 months

You wouldn't be able to apply quite yet because you need to have been present in the UK at the start of the qualifying residency period before your application, ie 5 years if you are not married or 3 years if you are.

Re: EEA citizen but permanent residency broken for 13 months

The six months only breaks your residence if you are still gathering time for the five years to get PR. After you get PR, you only lose it if you're going for two years. That's how I understand it, anyway.

Re: Citizenship or permanent residency for mentally ill

Your five years of EU treaty rights need not be the last five years. You can use ANY five years at all to get the PR, and then you just need to prove residency in the UK for the last 5 years (without having to meet the exercising treaty criteria). Citizenship for EU citizens is made up of those two ...

I agree, but why they said otherwise I don't know! I didn't risk it though so I just removed the few weeks under self sufficiency at the start that I had.

Re: Help with application time line

I was in a similar position originally myself and this is what the NCS and then HO said to confirm to them over the phone. I've never seen it written, though, and them saying it is the only time I have come across it. I don't quite understand why this would be the case, but that is what I was told a...

Re: EEA student with P60s during study period but not CSI

I would suggest applying for PR confirmation as it is only just over 50 and once that is obtained, naturalisation is much quicker and you would know that this wouldn't be an issue.

What was the nature of the employment? Was she employed continuously under a contract, for 2010-2014? It being few hours/not much money I don't think would matter, but if she was only employed for say, May-June 2010, then Aug-Sept 2010, etc. on temporary contracts, I think that could be a problem, b...

Re: Help with application time line

Periods of self sufficiency count toward your five years of EU treaty rights but only if they are not your first thing in the UK; what 'kicks off' the five years is employment or studies, so studies>self sufficiency>employment for example is fine, but with self sufficiency>studies>self sufficiency, ...

Re: Applying for passport without PR but 6.5 years stay in U

Yours seems straightforward enough in terms of essentially studies followed by employment. You've been under PR for the last 1.5 years, despite not having applied for it. I would go ahead and apply but explain it all very clearly so that no mistakes can be made in terms of how you qualified for the ...

Re: not sure which route if any

Being married to a Brit, would she be able to choose the non-EU-based migration laws, ie, apply for ILR based on the relationship and having had long enough residence in the UK to get ILR based on marriage (despite no marriage visa, the EU passport making that irrelevant), and after gaining ILR, app...

Re: EEA national, in UK for over 8 years: PR needed or not?

You lose your continuous exercise of EU treaty rights in the UK if you are gone for six months or longer in any residence year in the original five years that build up to you getting PR, ie: If you moved on 1 February of 2007, your residence year is 1 Feb- 31 Jan. Six months within one of those year...

I wondered about the certificate folding myself - I used an A4 sized special delivery envelope so it wouldn't get folded (didn't do check/send), but I guess they'll send it back to me folded in a smaller envelope. No biggie. Passport for: 1 Adult Application Type: New (Naturalised Citizen) Method of...

I read online that instead of sending other non-UK passports, we can photocopy every page in colour and send that in instead. Is this correct?

So EU citizens can't apply for it at all and thus switch to UK immigration rules? Strange that my caseworker advised that. She has a period of studies when she didn't have CSI I think. Oh well - she doesn't have much longer to wait to have a five year period anyway so I'll just advise her to wait a ...

ILR for EU citizen

So this isn't relevant to me since I have a naturalisation application which will hopefully be all sorted soon :) but I am wondering for a friend of mine, given something a caseworker said to me... She is an EU citizen (France) and came to the UK in 2008. She's married to a British citizen. My casew...
