what type of visa should my wife and baby apply?

I got ILR since 2015(pbs 5 year route) and my wife and I married in uk while she has student visa, then we leave uk for 1 year and our baby was born outside of UK. if i want to bring them back to uk, what type of visa should they apply? i think my wife need spouse visa? can my baby apply for ILR?

Set(O) if she is PBS dependent. Set(M) is for the spouse route, i.e. she become your dependent after you get ILR.

hi Vinny, thanks for your reply. We have not divorced yet. Even if we remain in the marriage until Jan 2019, she can not get IRL? I thought she can cos we will still be in marrage.

divorce impact for PBS dependency to apply for ILR

My wife is on PBS dependency visa of me since Jan 2014. What is the earliest time to apply for ILR for her? We are in divorce discussion but I still want to support her IRL even if we get a divorce. How will divorce impact the application? How can she still get IRL even if we divorce before Jan 2019?

thanks for your reply. Do you know anyone apply early and get visa? I just dont want to pay the fee and they reject me because i apply earlier. My wife will qualify ILR after 1 year so 3 year extension is quite enough for us.

BRP delivery

I applied PBS visa on 19th Feb and got approved. But I still have not got BRP delivered so far. I called DX and they said it was not with DX yet. it is being more than 10 days now. It used to take a few days only for my previous BRPs. Anyone else have the same situation recently?

Extension is not an issue. ILR is issue in that case. Sticky on Tier-1 mentions it http://www.immigrationboards.com/uk-tier-1-general-visas/convictions-and-tier-1-general-extension-t88652.html The post is in 2011, has anything been changed now? If not, at least I will still be ok to extend my visa....

so you mean dependent can still extend even after apr 2015 and apply for ILR after Apr 2018?

but if the parant has not got ILR yet, what visa can child have if he/she can not get dependent visa?

if it was fixed price penalty and there is no court involved than there is no criminal conviction. But if convicted by court, then depending on the offence you may have an unspent conviction.
