Re: Continuous residence broken during student exchange year

I have provided my advice based on the criteria you need to meet though it might not be what you would like to hear. Good luck with your application, whichever route you choose to apply through. I appreciate your help but I needn't you bring any criminality threshold into this equation as I am well...

Re: Continuous residence broken during student exchange year

The good character requirements have also been made tougher since Dec 2014. You would need to sort out your other issue before applying for ILR in either category or risk refusal and losing the fee. Listen, if I successfully appeal against conviction before I apply for ILR then there is no good cha...

Re: Continuous residence broken during student exchange year

Can it not be considered an exceptional reason at all as it was part of my studies here in the UK? I first applied for Tier 2 in the summer of 2011 so 5 years would be next summer. I wonder if UKBA has a record of all these entries and exits or are they and us supposed to go through all our passpor...

Re: Continuous residence broken during student exchange year

I did not, I was with a group of British students and none of us did.

No more than 180 days absence in any of the 5, 4, 3, 2,1 consecutive 12 months are allowed. This takes me back to 2010 when I had finished university and was working here on PSW, so will I be OK?

Re: Continuous residence broken during student exchange year

Sir, If you could help me with regards to the one year I studied abroad affecting my continuity please, without taking into account any possible conviction that would be great. FYI, I am in the process of appealing against it and will possibly get it resolved in time for my potential ILR application.

Re: Continuous residence broken during student exchange year

My UK student visa included a sandwich year of placement in industry in the middle of my studies (UK or abroad). My UK university sent me to the US as part of my studies for a year. I was on a US student/ visitor visa type sponsored by my university here. That year was covered under 4 years entry cl...

Continuous residence broken during student exchange year?

I plan on applying for ILR on the basis of 10 years continuous residence. 4 yrs on student visa/ entry clearance; 2 yrs on PSW permit and 4 yrs on Tier 2 (general) My 4 year student course consisted of a year in the United States July 2007 - July 2008. I, of course, had a valid UK student visa on my...

This page tells you how to consider an application when an applicant has or has had an absolute and conditional discharge. Re: Tier 2 extension - a total of 5 or 6 years?

Immigration rule 322(1C)(iv) gives as one of the reasons for refusing ILR applications : they have, within the 24 months prior to the date on which the application is decided, been convicted of or admitted an offence for which they have received a non-custodial sentence or other out of court dispos...

Re: Tier 2 extension - a total of 5 or 6 years?

I was in a lot of shock and I am unsure if there was a time limit attached with it (it's never just a *conditional discharge* without a clause though is it?) probably 2 years, I will have an official confirmation of it tomorrow. Does this mean ILR in September is out of the window? This gave me some...

Re: Tier 2 extension - a total of 5 or 6 years?

I was given a conditional discharge. This is for a fraud by false representation, making a £20 gain. Would my ILR be automarically rejected due to this? Will I succeed with a tier 2 extension for 2 years considering I've been 4 years total on tier 2 now? Would I qualify for FLR(LR) this year as Ambe...

Re: Tier 2 extension - a total of 5 or 6 years?

An extension should be ok as the general grounds for refusal doesn't apply. It depends on the offence and it's nature. You've gone with the crown, there is a ~40% change of acquittal if it goes to trial. You'd be better asking the question when you know the outcome. Thanks Amber, you're a star! I p...

Re: Tier 2 extension - a total of 5 or 6 years?

Would it create a problem to extend under any visa category in particular or all of them?

Tier 2? FLR(LR)? Article 8?

Re: Tier 2 extension - a total of 5 or 6 years?

If you are found guilty, the length of the sentence you receive will be a material factor. Then one will have to see, whether having regards to your character, your personal circumstance, including conviction, it is in the public interest to grant you an extension. Depending on the conviction and t...

Re: Tier 2 extension - a total of 5 or 6 years?

Either you are not found guilty and you get ILR or you are found guilty, and you don't get ILR or an extension. Well that is exactly what I wanted to know. What happens in the event I am found guilty. I have been told previously and just above that I would get an extension and on completion of 2 ye...

Re: Tier 2 extension - a total of 5 or 6 years?

Thank you very much Amber. At the end of those 2 years when applying for ILR, is there a salary requirement of 35k min? I've entered the country in October 1st 2005 and my current tier2 expires 20th of Sept 2015. Can I apply for FLR (LR) from Sept 1st as in 9 years 11 months from day I came to the c...

Tier 2 extension - a total of 5 or 6 years?

I came into the country Sep 2005 on a student visa for 4 years. Then switched to 2 years PSW permit. During this time for over a year I had a job (the same I still hold but stayed on PSW and didn't switch to Tier2 cos I'm smart like that!). I switched to Tier 2 General sometime August 2011 for 1 yea...

Re: Tier 2 extension with recent conviction

Anyone had any problems with this? Do they have grounds for refusal of the extension if you have ongoing court proceedings or have recently been convicted of a crime?

Also can you continue working for your sponsor whilst waiting on the HO decision if your current Tier 2 leave expires?
