Thanks John, The Dutch citizen has been working here approx. a year and a half, so she still has a way to go for the 5 years. Once they've applied at the nightmare that is the British Embassy in Tirana (as that is where they planned to get married), and they get the EEA Family permit, how long would...

John, jes2jes, Thank you so much for your support. John, you're right, I've made him keep every bit of paper in a folder in order of date, and I made him ask the names and position of everyone he spoke to. I think he thinks I'm mad! Now it's just fingers crossed that the chemo kicks the cancer! I fe...

GOOD NEWS!!! :D After another round of phone calls, I managed to get through to the Overseas Visitors Policy & NHS Costs Recovery Manager at the Department of Health. He confirmed what the receptionist was telling my friend was rubbish, and told me that as long as my friend was legally entitled ...

Basically, as far as I see it, she (the Dutch national) is exercising treaty rights by working in the UK. So she should apply for a residents permit with form EEA1. But as far as bringing her (soon to be) husband back from Albania, would he need to get a visitor's visa to come here and apply via for...

I've emailed and left a message for our MP - fingers crossed he'll get back to us. We'll go and see him at his open surgery on Friday anyway. They are juuuust coming up for 2 years together - by the time the Home Office get round to their case, it will no doubt be over the 2 years! I just really wan...

He's just tried calling the number to check entitlement to work at the Home Office to ask if he's entitled to NHS treatment. Their response? "Yeah, probably. Actually, we don't know". :x If he has this letter from the Home Office, does this qualify as leave to enter? They seem to have no p...

Interesting! Where on earth did they dig up that requirement? It simply does not exist! I know! It drives me up the wall that the receptionist at the hospital (and this is no dig at receptionists, as I'm one myself!) is telling people that when she clearly knows nothing about the rules! It just mak...

Dutch National with Non-EU Fiancé - how to come back to UK?

Hi Guys, Back for some more info please! My Dutch friend is living here with her Albanian fiancé, and he has been told he will not get ILR (he originally applied for asylum), but merely a 3 year visa. They would now like to go back to Albania and get married - what do they then need to do to come ba...

It says on his letter there is a number prospective employers can call to check his status with the Home Office. But really thinking about work is the last thing on his mind. What we really need to do is check if he is now eligible for treatment. His hospital are refusing to see his as he "hasn...

Sorry to give this a bit of a bump, but need some advice please. Our friend has now applied to the Home Office on the basis of his durable relationship with his German Fiancée. He's got a comfirmation letter regarding his application, and his immigration lawyer has said that he is now able to work -...

I've just checked and it's the same at the German Embassy - spouse must also attend. Can't make out if it's necessary at the Italian Embassy. My husband applied at the French Embassy in Oct 2005 for a visa and despite having to wait all day, I didn't need to go with him. It was bad enough he needed ...

Ooooh, Marie, I'd have been right behind you in the queue to smack them! My husband is also Albanian (applying for ILR at end of March) and when we came back into Gatwick from our holiday in Ibiza in 2005, the immigration officer said to my husband "Albanian eh? Usually we only see Albanian pas...

I'm not a doctor so can't claim any medical expertise, but bearing in mind the fact you mentioned chemotherapy earlier in the thread, I'm wondering if the real reason for the refusal is that such treatment may be clinically ineffective (rather than immigration status). From a quick review of the li...

Stedman, I'm pretty sure it's the hospital managers denying him treatment, not the doctors. Although the consultant's secretary is no longer returning his calls either. by denying a sick person treatment because of their nationality, I am effectively harming them. In this man's case the longer he is...

Apparently, he is not here illegally - he would only be "illegal" if he had been served with a deportation order, which he hasn't been. I don't know if this now changes things with a view to them getting married here in the UK? Does anyone know? Although that still won't get him his treatm...

The hospital have just called and said his treatment "would be a maximum of £900,0000, so what would you like to do?". It's unreal.

I've just spoken to a very helpful lady from the Refugee Council who sounded very helpful - they'd like to see him tomorrow to see how they can help.

Unfortunately, they are categorically refusing to start treatment until they confirm his status. He has had a biopsy and treatment up to date with no problems (apart from the fact they nearly killed him when he had his biopsy, but that's another story). Another friend of mine who has an Albanian sur...

Thanks guys, They are living together, but it hasn't been 2 years yet, and they don't have things like bills in both names anyway. I know a bit about getting married in Albania, as my friend had her wedding there. You need a certificate from a registry office stating that you are free to marry, tran...

His fiancée has contacted the German Embassy, who are insisting that both of them need an appointment at a registry office in German before they can marry in Alban...

Thanks John,

I'm not sure how long he's been with his girlfriend, I'll have to get my husband to ask him. I realise he can't marry here, as my husband and I just managed to marry before the CoA came in...

I just want to work out his options, as he'll need to work quickly on this one.

Friend here illegally needs medical help

I really hope someone here can help. A friend of ours (originally from Albania) is in the UK illegally (I'm not sure of his exact status - I believe he claimed asylum and failed, then "disappeared") and has been in the UK for several years now. He has been working, paying tax and National ...

Hi Guys! Just found this site looking for some info and I hope someone here can help! I'm British and my husband is Albanian. He's currently nearly 1 year in to his 2 year extension visa, and I'm now thinking ahead to when we need to fill out form Set M. A few things are worrying me: As it took us b...
