Re: Visa options with UK citizen child

Regarding "You are required to give the children's details even if you are not applying for their visa" I changed my mind after I saw the further questions, such as the countries my son has travelled to. Huh??? I would still like to know (and I intend to write to UKVI and ask them) why inf...

Ok I don't like the answer but I will accept it!

I did post on a new topic - it seemed it was successful as it showed by itself on a new page:

but something seems to have gone wrong!

Non applying children for FLR application

I am confused about this. The online form for FLR is asking about both the applicant's and their sponsor's children. My wife (applicant) and me (sponsor) have a young child together (he's a UK citizen), however I don't see why I have to give his details on the form as it's not required to meet the c...

UK residency dates for FLR application

My wife is applying for FLR after the initial 33 month visa family (spouse) visa. I've no concerns the application should be refused (i.e. she meets the criteria) however I am confused about how to answer the online form questions about where she's lived. She first entered UK January 2005 on a visit...

Visa options with UK citizen child

Good evening. My wife is coming to the end of the 'first' (33 month) spouse visa and so I'm looking at applying for the 2.5 year visa 'extension'. I don't think we will have a problem meeting the criteria. However as we now have a child (UK/British citizen) who was born since she arrived, can we app...

Re: Schengen Visa - less than 3 months left of the UK residence

The page https://www.gov.uk/uk-family-visa states: When you can apply to extend or switch The earliest you can apply is 28 days before your current permission (called ‘leave to remain’) expires. About the shortfall, my wife initially got 2 years and 9 months, and gov.uk website says you'll get 2.5 y...

Re: freedom of movement - British citizen and non-EU spouse

Probably several other threads covering this but basically I understand: 1. Yes (if by Europe you mean EU member states) 2. No (in theory) 3. We turned up at London St Pancras (heading to Paris) with both passports, UK spouse visa in my wife's passport, and marriage certificate, and French Immigrati...

Re: Schengen Visa - less than 3 months left of the UK residence

I notice there were no replies, but I have the same problem, can anyone offer any advice? UKBA will not allow my wife to apply to extend her UK spouse visa until 1 month before expiry, is there any way to have a trip to Europe in that nearly 3 month window??

Re: travel to europe withELR

Wanderer - when you say airlines will 'err on the side of caution', what right do they have to deny boarding? Surely they are discriminating unfairly etc if they don't respect the law? BTW, my wife went straight through French immigration (with me) at St Pancras last week with no schengen visa (I am...

Re: Dutch embassy refused visa

This may not be helpful, but as I understand it, you don't need a visa to travel to any EU country, so long as they recognise the travel document / passport. Regardless of what it might say on the embassy website etc. I posted just now about going to France with no visa. Took about 1 minute to get t...

Re: Travel to another EU country

This was my experience travelling from London to France via Eurostar last week. To clarify, we didn't make any application for a visa (e.g. to the French embassy or TLS) and my wife is Jamaican with a UK spouse visa. We went through security at St Pancras, and UK exit checks, then at the French immi...

Re: Spouse visa refused, reapplying

Thanks for the advice. I have submitted my letter to UKVI and we'll see what they have to say. Does anyone have an experience of using the county court (small claims) to reclaim costs in the event of a 'wrongful' refusal? Or alternatively claiming through a credit card provider for a service not pro...

Re: Spouse visa refused, reapplying

Obie - I am going to make a complaint to UKVI about the refused visa a while ago. You wrote before "where there are missing documents which they are required in law to request from you" - can you advise where this is written/stated?

Re: Travel to another EU country

I haven't had any answers on this one. I think I will slightly rephrase my question having done some more reading. Given the freedom of movement of EU Citzens and their family members, my understanding is that the French authorities must issue an entry visa (if they deem one necessary) at the port o...

Re: Travel to another EU country

Could I request (I'm trying to ask nicely here) Wanderer that you leave it for others to reply on this question. I didn't find your previous response helpful. I am stating our situation, and I would like an answer, rather than further questions which I don't know the answer to. Thank you.

Travel to another EU country

I am a UK Citizen (and resident) and my wife is Jamaican and lives with me in UK. We wish to travel to France (i.e. an EU country) for a holiday. It has been suggested (in another discussion on this site) that "Your wife cannot travel visa free under treaty rights because you have not and are n...

Re: Travel to Switzerland

Actually I meant I strayed from the topic, because I'm now asking about travel to France (or any other EU country) not Switzerland. Let's forget Switzerland and just cover travelling to France (which we also want to do, as a separate trip). Wanderer wrote: "Your wife cannot travel visa free und...

Re: Travel to Switzerland

OK it seems even more confusing now (although the points are mainly academic for me now). And apologies that the subject of discussion has drifted off-topic to 'travel to France'. So this is my understanding from what people on this topic have written (I will use 'spouse' as shorthand for family mem...

Re: Travel to Switzerland

CR001 - thank you for clarifying about the residence card. But are you saying that if I were (say) Polish and had brought a non-EEA spouse to live in the UK, then I wanted to visit France, I wouldn't need a visa to travel UK>France. But if I'm a UK Citizen (because my wife does have a visa to live i...

Re: Travel to Switzerland

Basel airport is in France, but the import point is that you can exit the airport into France, close to the Swiss border. The reason we might want to exit to France is that (as you stated) my wife would need to get a visa to travel direct from UK to Switzerland, but (as I understand it) we can trave...

Re: Travel to Switzerland

Travel to Switzerland

My Jamaican wife was recently granted a 2.5 year UK spouse visa and we live together in UK. We want to visit Switzerland (via Zurich airport), but I'm unsure of the visa requirement. I do know that: - Jamaican citizens would normally need a visa to visit Switzerland - regardless of whether she has a...

Re: Spouse visa processing times

Ok to complete the story... Decision made in the morning, we got the email in the evening of the next day, so we could collect from Kingston two days after the decision had been made. Supporting documents arrived (in UK) same day as collection from Kingston. And... she got the visa :-) Sorry I don't...

Re: Spouse visa processing times

Ok our case has got more complicated. After over 7 weeks (priority application), I got a call saying they haven't yet received the supporting documents. I said they were received at Sheffield the day after submission/bio in Kingston, gave them tracking number. Then the next morning they rang to say ...
