Can the government discriminate against disabled people because they are drawing a disability allowance? Hmm. Surely there must have been a case on this already, and if there isn't then there should be.

I don't have a massive amoutn of sympathy for employers in this situation, as it is quite easy to do checks. When the rules started getting harsher, my dad did an immigration audit .... There were few which he wasn't sure about, so an hour in the pub with me checking them out not only got them sort...

John, my grouse isn't about which businesses are targeted but it's about which businesses are affected. Are you saying that if I don't step up my vigilance I'll still be eligible for the old penalties for employing people without permits? So let's face it, for the majority of the population, well ab...

As an employer my bet is that I'll be paying more and more for government incompetence on immigration. Just like my accountant bill is inflated to administer convoluted and senseless revenue/tax legislation. Just like I pay my security company for a higher level of monitoring to make up for police i...

Don't miss the ID cards by the back door. First, impose them on the immigrant workforce who can't really protest. Once we've played fast and loose with the personal data of the visa victims we can roll it out to the rest of the UK. Perhaps moving on to benefit claimants next. Eventually, all your ID...

I can't find the link now, Jaj. Looking at the Indian Embassy site FAQ again it appears I may be mistaken on the 2002 date. If that's the case then all my children are eligible for OCI and my wife is eligible for PIO.

I'm telling ya, she married me only for my passport! ;)

Appeal tribunals - as with most magistrates/judges/recorders in the legal system - get impressed by meticulously done research and careful preparation. It panders to their ego and makes them feel favourably disposed towards you. My solicitor rightly told me there was not much point, so I'm going to ...

No, the HO doesn't have need to take anyone's word for anything. Why should they? They've got the option of turning him down. Either he has very strong documentary proof or he hasn't. That's it.

that therefore means that I am also lieing! What right do they have to say I'm a liar. What redress do I have against this? First, I'd calm down ;) These jobsworths are just doing what they were told in the training class last week. They could have been told - and it's highly likely they were - to ...

What if he doesn't? What if he is in a coma? According to your position nobody can overstay unknowingly. There is only one meaning for "nobody", check it out ;)

Cynical, yes, but you may have a point. The fees are proving a nice little earner (with a nice monopoly for punitive pricing that bears no relation to processing cost). Give the pen pushers some targets in percentage of applications refused, have some in-house competition/reward for the ECO with the...

Can people become illegal immigrants without breaking the law? You can believe the answer to be either Yes or No or don't know. But anyone saying they believe it and don't believe it ends up looking silly. Actually, I can! Nope, you can't. But if you cut and chop and reword my sentence to leave most...

I thought it was an offence to knowlingly overstay And it is. Docterror's comment that you were replying to was about overstayers in general, and not any particular case. The "knowingly overstayed" would be just one type of overstayer/illegal immigrant, albeit a sizeable chunk. Not all ov...

I don't have a criminal record but it's pretty easy in modern Britain so it's just a matter of time for me. One day a speed camera (oh, sorry, "Safety Camera") is going to catch me confused by a barrage of signs and a postal strike will prevent me getting the paperwork. Or I'll end up join...
