Re: CoA no right of work but married

Buongiorno Alessandra, I don't think that's the law, but the interpretation they are trying to give to the law. It's not scaremongering as someone said before, but the reality. They are giving a hard time to the EEA family members and the process is changing each day to make it more restrictive. Th...

Re: CoA no right of work but married

Hey all the most dramatic moment expected arrived. My husband's employer found insufficient proof for him to keep working and yesterday they decided to send him home until he provides a CoA. We are quite frustrated to say the least, we sent email to HO and we just received exactly the same copy of ...

Re: marrying a spanish citizen in uk with a non eu partner (no papers)

Hi James, Thanks so much for the reply. Its been enlightening for me to know that your Spanish and a lawyer at the same time. At the moment my boyfriend is been living or residing here in Uk for many years so i dont know if it will be an obstacle although he has a place in Spain too. How does that ...

Re: marrying a spanish citizen in uk with a non eu partner (no papers)

You won't have a legal right to enter Ireland and there is a 3 month notification period for marriages in the Irish Republic. You face the same issues there that you would have in the UK. I suggest you return to your home country, marry there and submit an EEA FP application to re-enter the UK lega...

Re: CoA no right of work but married

It would be another small step to getting immigration down to the tens of thousands, even though it's not as big a victory as keeping a Briton and family out by refusing the non-British spouse a visa. Oh, please. This is just scaremongering! First: the "tens of thousands" is PER YEAR and ...

Re: marrying a spanish citizen in uk with a non eu partner (no papers)

Having married in Spain (where both my husband and I were long-term legal residents) I know from personal experience that even marrying in a small town/village, the process is lengthy as all paperwork is sent to the provincial authority. This can take up to 8 months when the marriage involves a for...

The message you received is just an automatic response from their server. Nevertheless try to send the letter with special delivery and tracking to the caseworker if in three or four days you don't receive a new CoA. You can send it to: UK Visas and Immigration PO Box 3468 Sheffield S3 8WA Add your...

Re: CoA no right of work but married

Good Morning, They are doing that in most of the applications. They use templates so don't worry too much about the wording in this case. Send them a letter with special delivery and/or an email to: nweurocoarequests@homeoffice.gsi.gov.uk Request a new CoA with right of work, you should state clear...

Re: Which route to take to Sue the Home Office

@khers Unfortunately my MP is indeed a Tory. That said, he has been very helpful and really pressed the Home Office on my behalf. From the correspondence he received (and FW to me) the Home Office : 1. Admit to a so called "hot tasked enforcement visit" 2. Admit to negligence of supposedl...

Re: Non-EEA family member after Divorce

Good Morning Kiwi, I think you've got to check very well the regulations because as you describe your case, my opinion is that you have retained right of residence according to the regulation 10 (6). For that reason you fulfill the requirements of the regulation 15 (1) (page 25) that is permanent re...

Re: Which route to take to Sue the Home Office

Good Morning, This is just outrageous. I cannot believe they are going so far. I suggest you keep escalating the complaint through the Home Office's procedure, they will keep mostly not upholding your complaints, but at one point you will be able to go to the Ombudsman. Try to involve your local Mem...

Re: Non-EEA family member after Divorce

Good Morning,

Since when dependent parents are considered Extended Family Members???

And after many years of marriage and a child I don't think they will raise the issue of marriage of convenience.

Just my humble opinion,

Best Regards,

J

EEA Family Member - BRP after appeal allowed

Good Morning, I have applied on 1st September, 2015 for a residence card as a direct family member (spouse) of an EEA national. My application was refused in March 2016, I appealed to the First-tier Immigration and Asylum Tribunal, the appeal was allowed 7 October 2016. The Home Office has not chall...
