or apply again flr fp within 28 days...if u reach 10 years minus 28 days before ur case is decided, vary ur application to set lr. if ur case is decided before, then there is prob....in both cases there is risk involved but u have to take chance...u got no option...one option is if u get tier 2 with...

u can apply 28 days before completing 10 year..so ur date is 25 July...if u dont get any decision by then i think u should be fine...otherwise should apply again within 28 days of decision. u should have applied for Flr fp not Ilr

I just went through right of appeal document...it says Human rights claim made while the claimant is in UK (and certified under section 94 or 94B), u will get out of country appeal. your human right claim was certified under section 94 thats y u got out of country appeal...check the document page 20...

it seems that case worker made a wrong decision by not giving u in country right of appeal. U should discuss with ur lawyer whether he can raise this error or not

Then perhaps OP should challenge their denial of his rights of appeal by appealing directly , preferably within the time limits. @ Vinny The rules clearly say that the following applicants will get right of appeal rather than AR even after 6 April 2015. If u read the last paragraph...so why...

brother u have to take risk...u dont have any other choice...only tier 2 is the safest way...i think u can easily delay bio for 2 months...these days home office processing very slow. i applied on 20 may and i haven't got any acknowledge letter nor bio letter so far...when did u get bio letter after...

i have given u a good advice ...i m going through the same situation..i applied on 20 may 2015 and short of 7 months...my solicitor gave me this advice...did u apply through solicitor or ur own....

dont worry...when UKBA make decision on ur set lr application, 2 month will have passed and ur 10 years will be completed..so they will give u positive decision..tell me wot letter says about certifying claim..did u apply through solicitor..did he raise human rights grounds

yeah you can apply within 28 days for another visa...wot the letter says about certifying the claim...i thought human right applications will get appeal right...take a advice from a good solicitor...you should apply for ILR- set lr....u should be fine...when they make decision u will have cover ur 1...

Hi Vijim u talking about JR after they refuse u with no right of appeal...dont think about JR, JR period dont count towards 10 years. u got 10 months short, which is longer period. try to find tier 2 sponsor...but if u can't then go for flr fp...if refused with right of appeal u will be lucky, u wil...
