Re: Entrepreneur visa extension

Regular user - I am not certain on what would be included on 12pay data that you would copy paste. I would suggest that you speak to HMRC and they may be able to send you the RTI data as your payroll software is not generating it. Director Loan and remuneration are 2 different things so why would th...

Re: Questions answered Entrepreneur visa extension

Hi Tuhc Yes, original P46 - P46 were never used by HMRC but was a requirement for an employer to fill in for an employee without P45. I have still instructed my clients to carry on and so did I for my company. It ensures that Home Office is aware of the exact start date of the employee. Hi Irana, I ...

Re: Questions answered Entrepreneur visa extension

I don't think you can do it manually as one it will take alot of time and 2 the calculations are quite complicated for a non-accountant. Re: Questions answered Entrepreneur visa extension

The one who said that their software cannot produce FPS are probably using the HMRC free software. Your best bet is to contact HMRC and tell them that you have lost the documentation and your software backup and would like the copies of all FPS Anyway, I have used the FPS from the software I use for...

Re: Questions answered Entrepreneur visa extension

No, you don't need to have commercial premises. You need to understand that Home Office is aware that a number of businesses are run from home. However, the commercial premises, could have an effect on genuine entrepreneur test. I have an office.

Re: Permission to appeal refused

Thanks for the confirmation. This therefore leaves me no option but to apply for my Entrepreneur visa renewal within 28 days from 27/01/16 (the date on the UTT permission to appeal refusal) I dont think, I would like to risk my Entrepreneur visa renewal in case if the JR is also refused unless you e...

Re: Permission to appeal refused

I am not sure how it is a procedural error if Home Office did not argue it as they understood their guidelines and FTT judge clearly gotten the law wrong. Either way, the FTT judge refused my appeal based on that error and yes there were fair chances of success if the error was rectified. The questi...

I left UK in 29/08/2010 (student visa was valid till October 2010) and came back to UK on 28/12 2010 with a PSW visa (visa issued on 20/12/2010). As per long residence guidance, it says that there is no break in residence as long as the applicant left UK with a valid leave and returned with valid le...

Re: Permission to appeal refused

ILR was applied based on long residence with 1300 days plus absences. The absences were due to medical reasons and I applied with a hope that excessive absences will be disregarded as per Home office guidance, which they did not. Concern here is that FTT got one of the major law wrong based on which...

Re: New application while ILR appeal in process

I must add something that you guys may want to look into regarding section 3C & 3D. If the application was refused and the right of appeal was given, while the existing leave is valid and not curtailed (as in my case) than section 3C & 3D may not apply once the leave is expired. This is beca...

You are right as to why was I given the right to appeal, when I had the valid leave and yes it is under Human Rights. Have you seen any cases where right of appeal was given with valid leave and why? I would not say it was your mistake in overlooking my valid leave, when right of appeal is usually a...

New application while ILR appeal in process

Dear All, I am currently on Entrepreneur visa, which is due to expire on 17/12/2015. I applied for an in person ILR on 02/07/15, based on 10 years, which was refused due to excessive absences of 1400 days. You are right Simon, it could either be a typo or meant to be written that way. However a discretion can "not" be used in your favor would have made a lot more sense. I will use it either way to create diversion. The only option I have left is to argue based on compassionate grounds. As th...

Re: Applying for Long residence ILR with over 1400 days abse

I do spend quite a lot of time in Canada, which is because my wife has been followed by the same doctors when the illness started in 2001. This was even recommended by a UK doctor. When the illness was dormant, she was with me in UK. Why do I want ILR? As explained above, I have a genuine business i...
