Renounced citizenship & child benefit

Hi all, I am from (and currently living in) Northern Ireland. In 2016 I renounced by British citizenship - allowing me to bring my non-EU wife to NI using the EU family permit route. I used my Irish passport to do so. My wife received her UK residence card in early 2017 and it expires in 2022. I pla...

Re: Earnings (£) Advice Please!! - Qualified Person (Worker)

Yes, UK HO now applies this domestic test to hard-working Union citizens on the EU migration route. The test is applied to the sponsor; the activity of the non-EEA national is immaterial. Thank you noajthan - I had already known that the activities of the spouse play no part in the outcome of the a...

Re: Earnings (£) Advice Please!! - Qualified Person (Worker)

EU law simply states that work needs to be genuine and effective ; there is no specific requirement set for number of hours, payrate, payment of tax(/NI) etc etc. UK then applies its PET/MET tests on top of this. This is above and beyond the cleaner, purer EU law. See https://www.freemovement.org.u...

Earnings (£) Advice Please!! - Qualified Person (Worker)

Hi everyone, I am an EEA National living in the UK with my non-EEA wife. She arrived on an EEA Family Permit in mid June so we have only been living here in the UK for one month, but I have already applied for my wife's RC on the basis of me being a self-sufficient / job seeker. The referendum made ...

Re: Brexit better for non-EU migrants

The precedents are good for you. 2012 saw two significant changes - dual nationals lost their EEA privileges (McCarthy) and domestic spouse settlement was made significantly more difficult. Those who applied to start the use of the old rules before the changes came into force have been allowed to c...

Re: Brexit better for non-EU migrants

The blog is referring to the Surinder Singh (SS) route, which from your post doesn't apply to you. yea that's what I thought, however the wording is slightly confusing regarding when the couple were married. A previous poster mentioned about it being better for people to divorce ! My fears all revo...

Re: Brexit better for non-EU migrants

In any case, it looks like UK nationals will be forced to go to an EEA country with better immigration laws than the UK, get their fiancee to immigrate, marry and then return to the UK. People who made the mistake of getting married already are screwed, unless they can perhaps get a divorce or annu...

Thanks everyone - I am compiling the application packet right now, meeting a solicitor tomorrow for review and if he feels it has a strong chance of success - I guess I will be posting it off! I would just like to have been told from the powers that be - regardless of the outcome of the vote, that c...

Re: Post Referendum / Residence Card

Post Referendum / Residence Card

Hi everyone, My wife and I arrived in the UK last Tuesday (14th June) - I am an Irish citizen and my wife is an American. We arrived on an EEA Family Permit, valid from June 1st - Dec 1st 2016. Even though I have only been in the UK a grand total of 7 days - I am panicking that I should apply for my...

Re: NHS / Self-sufficient Advice Please!

Sounds like you're on a roll. All of the above will generate a papertrail. No doubt optician, dentist, council tax, car insurance etc to follow. UK EHIC may come in handy (one each). The rest is optional and personal choice: church (etc), gym, library, dance/language class & etc. Here is anothe...

Re: NHS / Self-sufficient Advice Please!

Its a little complex as, being Irish, you have a form of settled status and a right to reside in UK anyway. Due to CTA etc. But with your European Union citizen hat on you (both) have an initial 3 month grace period in UK then you (as a Union citizen and EEA sponsor) have to be exercising treaty ri...

Re: NHS / Self-sufficient Advice Please!

Well, government would appear to want to turn everyone in the frontline (Unis, NHS, landlords, employers etc) into immigration police , but perhaps that's one for the pub. You have probably found this already: http://www.hscni.net/ Suggest dig into the ' habitual residence test ' (hrt) to see how t...

NHS / Self-sufficient Advice Please!

Hey folks! I arrived in the UK a few days ago (Irish citizen with American wife using EEA Family Permit). Hi sp84, Thank you for your quick reply and congratulations for your RN :) Actually we live in UK, so we applied for EEA (FM): Family member or previously called EEA2 (from inside UK) - which as u know takes average 6 months - Not the FP Route. My wife got her we family visa took about 6 working days. No interview. She is arriving tomorrow 3 June. All the effort has been worth it. We are also moving into own rented place also.
