HSMP JR refund

I wonder if anyone has already received a one-off refund as a result of HSMP Judicial Review? I applied in may and received a letter from Home Office in mid June that the refund was granted and I should receive a cheque. But nothing has arrived yet.

at this stage it will be ironic if we win: too late to make any difference to most of us, I think. a Pyrrhic victory, win the battle but lose the war. it is hard to believe that this is not being dragged out deliberately... and cynically. my 5 years are up in January so we will probably be OK, but ...

I like the analogy as well! Now to continue the analogy: So can we do anything about it? The answer is probably yes. Like in personal finance, things like endowment mis-selling, unfair bank charges etc have been successfully shown and can be claimed back. But it needs a FSA or OFT type office to do...

In my opinion legal actions should be the last resort and taken after all lobbying means are exhausted. According to the advice I was given our case is not partcularl strong, epecially for WP holders.

However we should be ready to go ahead with JR if the need arises.

I asked for advice some time ago. It was not very optimistic. The case will take a lot of time and money while the results are very uncertain. Though it was while ago, so maybe something is changed now...

please note that taking the case into court makes sense only for those who were two years on a working visa. My guess that it would take a couple of years before the decision is made. So people who were here for 3-4 years will get ILR anyway by that time.
