Re: British citizenship application, overstayed by around 40 days in 2011

Hey guys, I've already had a reply from the HO and was finally granted the citizenship, I could not be any happier 😊 good luck with yours.
My gut feeling paid off and I might have been lucky this time but still thanks to the support from everyone in this forum, those who encouraged and who didn't.

Re: British citizenship application, overstayed by around 40 days in 2011

Hey guys, thanks for the reply, it is a gamble I am willing to take instead of waiting not knowing that I could be eligible. I sent my application last week with a cover letter explaining the situation and my argument along with a p45 from when I quit my job in order not to breach the law by being a...

British citizenship application, overstayed by around 40 days in 2011

Hi all, once again I find myself in need of your valuable assistance. I am about to send through my application for a British citizenship, having had my appeal for my permanent residence granted and permanent residence acquired since July 2016. I have however overstayed for around 40 days in 2011 an...

Re: EEA PR refused and appeal or send a new application?

Re: EEA PR refused and appeal or send a new application?

Hey guys, some more good news finally, I have just received a letter from the HO that they will not challenge the court decision and my case has now been handed to post decision casework unit. The letter was very vague however as it didn't state the next steps and what is needed from my side as my p...

Re: EEA PR refused and appeal or send a new application?

Hi Ribena, Thanks a lot and good luck with your application :) I certainly can't understand their decision based on their own guidance and regulations, I believe the requirement is that I have lived in the UK for 5 years and I can prove that I was working since the retained rights was granted Requir...

Re: EEA PR refused and appeal or send a new application?

Hi Obie, I have been in the UK for the last 11 years now and have proven I resided in the UK for the last 5 years along with my employment history for 5 years so that shouldn't be a concern. I have met these requirements but the HO argued that they needed to see more evidence of my ex treaty rights ...

Re: EEA PR refused and appeal or send a new application?

Thanks a lot :) I have to say it was very satisfying seeing the look on the HO representative when the judge gave her verdict imminently rather than in 2 weeks. I wouldn't have thought the HO would appeal but guess I have to wait and see. I will try to preempt further delay and as soon as I receive ...

Re: EEA PR refused and appeal or send a new application?

Hey guys, I had my appeal heard today and the judge decided there and then to grant me my appeal, that is based on the fact that I shouldn't need to provide evidence of my ex's treaty rights again since I was granted the retained rights of residence, regulation 15 and 10(1). My question is around th...

Re: EEA PR refused and appeal or send a new application?

Hi Ribena, Sorry I have only checked your message today. I have been trying to get more information from the HO on the reason behind rejecting my application and involved my local MP in the process. The reply from the HO is that I haven't provided enough evidence that I have tried to obtain document...

Re: EEA PR refused and appeal or send a new application?

I have lodged the appeal for an oral hearing on time and now waiting... 18 months is a very long time and it's already affecting my state of mind, would you recommend sending a fresh application as well? the HO requested business bank account or tax and national insurance payments, not sure if I wou...

Re: EEA PR refused and appeal or send a new application?

I will definitely consider appealing, just really don't want to go through more disappointment, time waste and stress... what I can't understand is the accounts were valid at the time of divorce even if they have considered only the period from when she filed the divorce to the time I have submitted...

EEA PR refused and appeal or send a new application?

Hi Guys, Looks like my life is a constant battle with the HO, I have just received a refusal for my PR application based on the fact that I have not submitted enough evidence of my ex wife exercising her treaty rights in the UK. I have a retained rights of residence from October 2015 where I had sen...

ILR refused and right tin appeal

Hi guys, Looks like my life is an ongoing battle, I have just received a refusal for my ILR based on the fact I did not provide enough evidence of my ex spouse exercising her treaty rights during the 3 years marriage period. I had applied for a retained rights of residence in Nov 2014 which was gran...

EEA PR- when to apply

Hi all, I am as probably most EEA card holders out there a bit worried about what the future might hold following the referendum in June! Married on 04/05/2011 which unfortunately lasted till the decree absolute in October 2014. ROR was then granted in October 2015, a year later. Initial family card...

Re: EEA retain rights of residence visa with 5 years extensi

I also read that the 5 years starts from the date of the marriage certificate rather than the date the family card was issued. Nevertheless, I still have almost a year to apply for PR then.
Thanks and good luck with yours :)

Re: EEA retain rights of residence visa with 5 years extensi

Oh I see, thanks a lot for the advice, I will get in touch on Monday then. Sorry for being nosey but Did they also cancel your first family card visa and issue another 5 years? I have read in different threads that you need to be resident for 5 years, that is the 3 from the initial family card and 2...

EEA retain rights of residence visa with 5 years extension

Hi all, I am looking for an expert advice if possible as I am very confused with my current status and the letter sent through the HO. To keep it simple, I am a non EEA citizen who as been in the UK since January 2007. Had a student visa, then a PSW and lately an EEA family card having been married ...
