Home office guideline says they apply discretion (upto 3 months) regarding waiving immigration time restriction at the start of the 1 year ILR period if : ..... 1...

It was in person. Yes I was asked to pay after the caseworker confirmed that he would give me ILR. I think this is the benefit of applying in person.

Hi! I am an hsmp -holder plannning to apply for ILR next month. During last 5 years I have been to holiday for 3 times. ILR enquiry for HSMP

I am in HSMP category and planning to apply for ILR next month based on self-employment income. My understanding is that someone is economically active to qualify for ILR. Can anyone has any idea how to prove that I am/was economically active as a self-employed.

Any experience? or advice?

Thanks

ILR quiry for HSMP

Hi! Thanks for comments. I have read the guidance. The rules only required to be economically active (unlike HSMP extension) for the last 5 years. I was economically active for the period. I have been lecturing in a UK public university, but the contract is only during session time. So, no doubt abo...

Legitimate expectation appeal suceeded

Two members of the hsmp forum succeded with their leave to remain appeals on the grounds of legitimate expectations and human rights. I hope these references are very relevant for 4 to 5 years rules change for ILR application.

We have a good case for LEGITIMATE EXPECTATION

As per previous case laws I think it is a good point for the judicial review submitted by Mr. Stephen Kong for retrospective ILR rules changes from 4 to 5 years. The lawyer have to show the HO's written commitment regarding qualifying period of 4 years for HSMP applicant.

You see Home Secretary used tricky words to answer the questions. He tried to explain that if HO decides to cancel someone's existing leave under...

I think it implies that if HC accepts the appeal HSMP doctors will be treated like local british citizens when their application will be processed, which the Department of Health previously declined to accept after last immigration rule change. Moreover, there are some other issues with the doctors'...

Re: 7/11 is evidence against 4-5 changes

I have completed (1+3) 4 years under hsmp on 12 Nov. 2006. Applied for extension using FLR(IED) under old rules on 10th Nov. The initial declaration by IND said old form would still be accepted until 4th Dec. But, after applying I saw that they gave another announcement ( on 10th) saying applicants ...
