This is fantastic! as far as I am concerned it is all there, if the politicians, bureaucrats and public have eyes to see. Whether it will lead to any action is of course very doubtful so long as the HO uses arguments like balancing the "needs of applicants" and the needs of coherent UK pol...

try-one, was your last FLR as HSMP or WP? I thought if you switched then you were given new LTR. Unless I am wrong about that (and I might well be), you can still count time as WP holder if you apply for ILR under HSMP, provided you were on HSMP status at the time of ILR application. Basically if yo...

Nonothing, I sympathise totally with your frustration; I feel just as wounded by all this. But it all boils down to these words of Liam Byrne: I do not accept that those who receive a grant of leave in a category have a legitimate expectation that the rules for further grants of leave within that ca...

I agree with Rog: so far all the hurdles have been put up to stop people getting to the ILR stage; but when they realise that many will get there anyway despite inconvenience and hardship in some cases, they will have no other way to produce the reduced ILR numbers that are at the root of all this, ...

Smit, I think you are missing the point. The post-7 November Rules do not have to "fit in with" the post-4-to-5 (April 2006) situation. What they have to fit in with is the overall task that Messrs. Reid and Byrne have obviously taken to heart: dramatically and quickly reduce the number of...

where does it say that points for experience are abolished? not on the link provided on the workpermit.com website to which the link leads. Have I missed something? Where is the correct information on the new criteria, if not there?

thanks

Well, since we seem to be in a limbo-time while our last chance to reverse the pernicious 4-to5 ruling plays itself out through Judicial review, I will add my 2 cents' worth to Badhorse's obviously heartfelt and logical lament. I am an American HSMP who just missed ILR and am severely inconvenienced...

The decision on this issue will not be affected by any of the arguments made by (1) affected persons or (2) politicians of the opposition. We have no constituency, are not real hardship cases like poor asylum-seekers facing a death sentence (real or otherwise) if they are returned home. Many of us a...

Shortly after citizenship, I'll probably be out of here because that will give me the right to live and work in any other EU country. I won't feel that I owe the UK anything since they would have taken thousands of pounds from me at that point. I fully sympathise, but would not advise trumpeting th...

I've got my extension of HSMP today for next 3 years. However, my daughter's application is still under consideration, she's over 18. surely your daughter was under 18 when you entered under HSMP? how can they "consider" her any differently from you? that has me worried! (my son in same p...

Let's suppose they DO require existing HSMP or WP holders to apply under the new points system: does ANYONE think they would make the only (relatively) generous part of the new system (ILR after 2 years for Tier 1) applicable to people already here and who would thus qualify immediately for ILR, pro...

Yes writing to MPs is cheaper but does it work? No, it really does not work, not in the case of Labour MPs at least. Mine has written twice to HO and twice forwarded to me their boilerplate, same as you have all seen, with no promise of anything other than "sympathy". So the party of Gove...

here is an interesting summary with some useful points of view, from http://www.lawfirmuk.net/english/newchanges.htm VBSI might do well to ry and link up with those folks as well as ILPA.. One of the major changes that are proposed to bring forward is to extend the time frame of eligibility of indef...

Re: 5 years for ILR rule implemented

of course the bureaucrats at IND will say the same thing they said before, but hopefully we can take advantage of the "new broom" period to highlight one of the things the bureaucrats were and are getting wrong. Of course they can say that mortgages and tuition fees are outside their contr...

supertiger, do you have a copy of their letter to TM? I would be happy to write to them and suggest they should try again now that there is a new crowd at IND.

some time ago I suggested that the OISC firms who make a living helping people through the hurdles to UK residence and work should speak up on our behalf. I did not get any response either from members of this forum or from the OISC-firm I had contact with (Jones Kelleher). Now I notice that there i...

sowhat, are you applying now for ILR after 4 years? I wish you luck, if it works that will be a fantastic precedent!

hopefully at least they will apply the fee to a FLR application if it bounces.

Re: Chain Mail

its very long.. can we shrink it down by giving the refrence of the Board/Thread. it should be short and only contain the usefull information. Also I am thinking of sending this to People only who are affected by this change. the reason will be to 1) Increase awareness so that they know they are af...

Re: Chain Mail

One of the most important of those Rules stated clearly that in any work-related immigration category, we would have the right to Indefinite Leave to Remain (ILR or settlement in the UK) after 4 years of residence provided we fully abide by the stringent rules and regulations governing our presence...

Fine, let's hope for the best. In future I definitely think we should say something stronger than just we were "under the impression" we had ILR after 4 years. We had what for all intents and purposes was a contract! I had a mortgage rejected because I do not have permanent residency, btw....

a few suggestions; where the petition says: , including with retrospective effect for those who had applied before 3rd April 2006. We believe the rule has a negative impact on existing work-related category visa holders, who were under the impression that they were eligible to apply for ILR in the U...
