Hi there,

If you've been married 3 years and more and have both lived in the UK for at least, 1 year and living in the UK when the divorce happened then yes your parents can apply for retained rights. Good luck.

Hi there,

You have full custody with court papers for a minor child who is orphaned. I don't see any issues as you're now the minor child's legal guardian, so should be seen as your own child now.

If you're outside the UK for more than 5 years then your settled status will lapse. If you're returning for a day or two a year which really, you'll be using your settled status as a form of visit visa, it may be up to the officials at the border in the future as you're not living in the UK as a set...

If the marriage de-facto no longer subsist it will be a false declaration. Hi, You need to let HO know of your change in circumstances as your status is based on her being your sponsor so that once you apply for retained rights and it's granted, you won't need your spouse' details when the time comes to apply for settled status hence the importance of notifying the HO now....

yes, resets to 5 years again but if you want citizenship, must stay in UK for certain number of days to be eligible.
