John, Thank you very much for the detailed response. Do you have a link to the EU regulations that changed on 30.04.06? My problem is that I want to start up a business in the UK and the HSMP route seems to be closed for Romanians. If I apply for HSMP now, my understanding is that HO will issue me a...

4 years and 3 months :)) I would have qualified for ILR at 4 years in September if the government wouldn't have changed the rules increasing the qualifying period to 5 years. Basically according to these new rules for Romanians and Bulgarians, I can apply for a registration card giving me unrestrict...

What about the romanians who work legally in the UK? Do they have to do anything?

What if a Romanian legally working in the UK wants to switch from WP to HSMP? What forms should that person use?

Just a quick update from VBSI: We will set-up a meeting with Harvey Son& Filby in the next 2 weeks to discuss our potential involvement in the JR. I am currently waiting for Stephen to confirm a date when they are available. As for the JR, HS&F are waiting the Court's decision on their appli...

No, I cannot suggest / advice you to do that, this is something you need to decide on your own. I was only passing the message from HS&F for people who decided to apply regardless of the change of the rules, have been denied ILR and now could be interested to join efforts with HS&F in their ...

This refers to those who applied for ILR after 4 years and have been denied ILR because of the 5 year new ruling. HS&F invited them to forward them their cases / refusals.

I this answers your question.

Dear all, I just wanted to give you an update on the legal case front. Since my last post I have joined VBSI to look into the legal alternative in case lobbying will fail. I already contacted Stephen Kong asking him to meet me and discuss the current status of the JR application, also mentioning to ...

Regardless of whether we like or dislike the decision in the Afghan hijackers case, it shows one thing : HO can be defeated in court and forced to accept something they initially refused to. By the way, the QC defending the Afghans is the same one BAPIO used in their case against the HO ! BR, Paul

Dear all, I just returned from holiday and went through the posts in the last 3 weeks and I have to say I am very surprised to find out that VBSI although claims it represents the skilled immigrants, fails to recognize and to consider the legal alternative. I am sorry to say this but I find it very ...

It certainly not going to take 3 years :)) I have posted earlier this week the next steps in my opinion and I have suggested we should have people responsible for specific actions. If others will join me and we can agree responsibilities, including getting VBSI involved, I think it's worth a try :) ...

Do we have news on the judicial review application? If yes, we need to start the legal action ASAP, it's already 3 months since the changes and we haven't made any progress. I support the petition to Tony Blair, but we are not realistic if we think Tony is going to amend the rules for us. Legal acti...

I do :D , sorry for using it in the first place. Going back to our court case, I think It's time to get organized, I believe in " single point of contact / responsible " for each of the activities we want to undertake. That SPOC will collect the feedback from members, organize MSN calls an...

Chibuya,

I am afraid the 3 months time limit is very strict, I have checked from 2 sources.

But we are not being forced to dispute the 3 months period, as I believe there is a judicial review request already.

I agree with rooi_ding on the usefulness of VBSI and the good work they have done so far in collecting evidence and building a case against HO on the retrospective change of the rules. This work will prove essential, I am sure, in any court case, so from me personally, thank you to all of you who de...

I've lost any hope we will ever do anything on this collectively, as a group. While we sat here and filled in 86 pages with our opinions the doctors took HO to court and it looks like the HO is changing the rules for them. If we can't learn anything from this, then we deserve the current unfair rul...

Hi all, It seems to me we started to worry about things that might happen next year and forgot about the main topic - remove the retrospective element of the 4-5 years law NOW. There is a possibility the HO has a hidden agenda on ILR and they can potentially try to stop some of us to get ILR next ye...
