Re: Stamp 4 Revoked

The ICO has the ultimate discretion, and allowed your cousin to enter, as s/he was able to do so. The ICO was not obliged to do so. Your cousin was very lucky. It doesn't mean it will apply to anyone else. OP here was unlucky, but the ICO was not wrong. If it depends on luck than why did you say th...

Re: Stamp 4 Revoked

Obie, you keep repeating that his wife is exercising treaty rights, but you don't know that. Does she have a job? Is she self sufficient or a student? You don't know what she is and neither did immigration at the airport! I have read all your previous posts. FYI Upon landing at dublin airport my fi...

Re: Stages Of Retention

How do you know the clerk had rejected your case ?? Dont you think they were investigating your marriage even after the polish embassy e-mail ?? If they had taken a decision beforehand than they wouldn't give you any temporary permission to reside. Did you find out on what grounds do the polish emba...

Re: chenchooliah V Minister For Justice - Important Judgement On Rights Of EU Citizen Spouses.

I dont think your case is affected by the chencholiah judgement. The minister will surely tell your solicitor as to why the polish authority beleive that she was residing in poland. Your solicitor can only do something once they find out the reason as to why the polish authority said this. Are you s...

Re: chenchooliah V Minister For Justice - Important Judgement On Rights Of EU Citizen Spouses.

Just to let everyone know that retention applicants who are not impacted by the chenchoolia judgement are getting temporary Visa's for 9 months and when that Visa expires the immigration is giving another temporary 9 months permission to reside until a final decision has been taken. Their excuse of ...

Re: chenchooliah V Minister For Justice - Important Judgement On Rights Of EU Citizen Spouses.

The judgement does not prevent the minister from removing people, it only prevents him from deporting and imposing bans on entry. Therefore the minister can remove individuals whose family have ceased from exercising treaty rights. This judgement applies if there was a genuine relationship. A frien...

Retention cases are delayed because of the chencholiah judgement. The immigration is sending out letters and this is what the letter says. """ The position in your clients immigration case is that his case is impacted by the ruling of the European court of justice in the chencholiah c...

Employment Laws

Guys just a quick question.

Is Carta d’identità (Italian permanent residence card) sufficient to secure employment in Ireland ?? given that the holder of such residence card is a Non-EU citizen.
Please provide references if applicable.
Thankyou

Re: Bank statements for last 5 years

Their is a requirement of applicants bank statement but not sure why they have asked you for last 5 years day to day transactions. You should consult a lawyer and they should write a letter explaining that bank account does exist but not maintained in last 5 years. It doesn't look like that by not p...

Re: Bank statements for last 5 years

People dont necessarily use their card on a day to day basis so daily transactions may not be obtained. If i were you i would just simply write them that your wife does have a bank account but she hasn't used it in last 5 years as she depends on you and you afford all the expenses. By the way if you...

Since when the immigration started ringing the landlord? They usually ring the workplace to confirm the employment. Its very unusual. In my case the landlord was not willing to give his phone number but just the email so does that mean they will require his phone number?

Re: Self sufficient & Self employment

Best option is the employment of the EU citizen. If not that the EU citizen must be self employed or studying in a college. But they myst be engaged in any one of the activity listed in the form EU1. If you cannot show any of these activity than your application for a residence card may be refused.
