The most disgusting thing about the INS is that they are happy to wave whites travelling without visas through I think many "whites" with visa waiver passports would dispute this assertion based on their personal experience. I actually do dispute secular's statement - and I'm a US citizen...

Something that's been puzzling me from Upset's first post is her saying " and i have to live of social security ". Isn't this going to affect her husband's ILR application when the time comes, even if nothing else does, in the meantime? No, as a British citizen she can claim all the benef...

I am stating that as a fact. My (trusted) independent financial advisor stated that as a fact. The bank that I worked for stated that as a fact. Hmmm ..... I believe that members of this board have reported otherwise. And I did not suggest contacting an IFA. I said mortgage broker. IIRC, the member...

If the qualifying time for spousal ILR was raised from two to three years Why on earth do you think that such a proposal is in the pipeline? Do appreciate that the "probationary" time for spouse visas was raised from one year to two years as recently as 01.04.03. And even when that change...

John - As we've all seen with the work permit/HSMP/etc ILR shake-up, nothing is ever set in stone. If the qualifying time for spousal ILR was raised from two to three years in, say, Spetember 2008 and the spouse had waited to convert to FLR until November 2006 (instead of applying as soon as possibl...

Your wife receiving public funds is fine - she's a British citizen and is entitled to them. However, I would strongly suggest you ask a family member to co-sponsor you when you apply for FLR. While there is no set "magic amount" that must be in your bank account when you apply, the casewor...

OK, so form FLR(M) is the one to complete. And no need to wait until the end of the fiancée visa validity. The form, with the supporting evidence of course (especially the marriage certificate) can be submitted as soon as the marriage has happened. In fact, the quicker she switches to FLR the bette...

Whoever told you you can't apply to switch visas in-person is talking rubbish. I switched from a student to a spousal visa in person (Croydon PEO) last year.

Re: fiance visa ( minimum income)

Dear all I will be applying for a fiance visa, but need to know two things: What is the minimum salary the sponsor has to be earning to support his Fiance? There is no minimum. The sponsor must show that they can support their fiance(e) for up to six months so, as individual circumstances can vary ...

Re: UK passport holders... .EU drivers license quetsion....

<snip> But are you talking about applying from scratch (i.e. taking lessons if needed and doing a driving test), or are you talking about trying to exchange a non-EU licence for an EU one? (The UK allows that, for example, but I don't believe that the US is on the list of eligible countries, althou...

No, your wife cannot send you back to India. She cannot request to have you sent back to India (as long as you are on a valid visa) either.

I am fairly sure you can switch to an HSMP visa in-country, anyone else care to confirm or deny that...?

I'm sorry to hear about the breakdown of your marriage. The first thing you should do is go to your employer and ask them to sponsor you for a work permit. I can't comment on how successful that work permit application is likely to be as you've just said you're a "computer professional". I...

I take it you have family in the UK? If so, you can ask them to co-sponsor your husband's visa application. As long as they write a letter stating that they will act as a co-sponsor and provide bank statements and/or wage slips there should be no problem getting your husband a visa.

Why would anyone be sympathetic to people who break laws time and again and give all other immigrants a bad name ??
Seconded. Anyway, I doubt a solicitor could be of any assistance in this situation.

How long has your wife been out of the UK?

If it's more than 90 days then she will run in to trouble when applying for ILR; unless she's been out of the country for a very valid reason (for example: an illness in the family or work-related reasons).

Your fiancee can ask to have the visa postdated by up to three months - so applying in November and asking for a January start date should be no problem. As long as the fiancee visa is in your girlfriend's passport you should have no trouble. The reason she was being hassled by IOs is because they thought there was a good chance she was trying to settle in the UK using the VWP. As the fiancee visa is a settlement route, that reason to deny her entry ...

You are correct when you say you want a fiancee visa as that is the visa that leads to settlement in the UK. Your fiancee will apply in Jakarta, she needs to have all her documents with her when she applies. She should have proof of accommodation (mortgage statement/tenancy agreement and a letter fr...
