Re: British Nationality for child born outside the UK from E

your son will have to live at least 5 years in the Uk before he can apply for PR That might not necessarily be required, though it's entirely at the mercy of Home Office case worker. Mine is a similar case (http://www.immigrationboards.com/british-citizenship/eea-pr-requirement-for-eea-child-born-a...

Re: EEA (PR) for EEA minor born outside of UK

I am more than happy to inform that Home Office has been understanding and granted my son (as part of family application with my wife) citizenship (MN1 - Section 3(1) )! The timeline (for everyone's benefit) has been the following: * father granted citizenship in November 2014, * mother given DCPR D...

Re: EEA (PR) requirement for EEA child born abroad for MN1?

Thanks! That is definitely true - I shall post the outcome of my son's application once processed by HO! It's indeed a very non-straight forward case :-). I am more than happy to inform that Home Office has been understanding and granted my son (as part of family application with my wife) citizensh...

Re: How to apply for UK passport for pre ww2 polish citizen

I'm beginning to believe the uncle is ethnically Polish, but it hasn't been stated. I'm still not clear on how the Germans of pre-war Poland and the Ukrainians of pre-war Poland for the most part lost their Polish citizenship. Was the process restricted to those who physically ended up in Germany o...

Re: How to apply for UK passport for pre ww2 polish citizen

... 2. Original document proving your Polish citizenship: current Polish passport or/and Polish ID Card. You can still apply for your passport if your current passport is damaged, lost or stolen. If your passport has been lost or stolen, it should be reported immediately during a passport appointme...

Re: How to apply for UK passport for pre ww2 polish citizen

Given the present problems both the in the UK and Poland Is it going to be quicker / easier to apply for British Citizenship or start the process of apply for Polish citizenship. Thanks It's fairly likely, that anything related to Polish citizenship would require dealing in person (either in Poland...

Re: British Citizen (Naturalised) baby born abroad

My understanding is you (your child) does have the option to switch to UK immigration route. He is not locked into EU route. Yup, you look to be correct :-) - https://www.gov.uk/government/publications/eea-nationals-eun01/eea-nationals-eun01: EUN1.10 Can EEA nationals apply under the Immigration Ru...

Re: British Citizen (Naturalised) baby born abroad

Hmm, so you are contemplating moving over to the dark side - UK immigration route. I think you may have to. I don't really see how you could sponsor your child as an EEA sponsor anymore. And looking again at your timeline I can't see any way your child may have acquired PR in the past - as he hadn'...

Re: MN1 baby born abroad - parents being naturalised British

adam_now wrote: If all this falls ... I think ... your only hope is remaining in the country for 10 years and applying for his/her BC on that basis.
Correction on this - I think it only covers you if you have been born in the UK. So no real other solution I guess, other than trying UK Immigration route.

Re: British Citizen (Naturalised) baby born abroad

If operating under UK Regulations, my understanding is it now takes 5 years to gain ILR (unless any special clauses for minors can be found to apply). I don't think it're required for a minor to wait 5 years for an ILR with parents being BC. http://findlaw.co.uk/law/immigration_emigration/family_vi...

Re: MN1 baby born abroad - parents being naturalised British

thanks for the reply, But it must be a way.....we don't want to wait until he is 10 years old. It's unfortunately tricky. MN1 under section 3(1) requires the child to be free from immigration restrictions (to be then considered under discretion of Secretary of State, so still nothing certain). A st...

Re: EEA (PR) for EEA minor born outside of UK

In some cases , under UK regulations, such foreign-born minors can apply to register as citizens under section 3(2) or 3(5) of BNA if they &/or parent have resided in UK. That'd be only in ohara 's case? For my son, as both myself and my wife would by BC by naturalization we can only apply unde...

Re: EEA (PR) requirement for EEA child born abroad for MN1?

Read on to 9.17.24. & 9.17.25 which covers freedom from immigration restrictions ... We should normally a minor to be free of conditions of stay because the future of a child whose stay is restricted does not clearly lie here We should therefore normally refuse an application for the registrati...

Re: EEA (PR) requirement for EEA child born abroad for MN1?

However there is an expectation that a child born abroad is settled . For EEA nationals that means acquiring PR - which takes 5 years. That is clearly a challenge for a 4 year old. I would challenge the requirement for a child to be settled to qualify under section 3(1). The following document - ht...

EEA (PR) for EEA minor born outside of UK

Hi, Has anyone obtained an EEA (PR) card for a child? It's for a child of EU nationality born outside of UK to EU parent? * Father has obtained EEA (PR) in 2013 and subsequently BC in 2014 * Mother has obtained EEA (PR) in 2015 Hence such an application would need to be for the minor only, as both p...

Re: EEA (PR) requirement for EEA child born abroad for MN1?

Well yes, for UK route, ie under UK Immmigration Regulations, the child's status would generally follow that of the least-privileged (in immigration terms) parent. Thanks! Will just have to wait for HO to come back on our son's application? If anyone has had similar experience (though I appreciate ...

Re: EEA (PR) requirement for EEA child born abroad for MN1?

The guidance is indeed unclear for EEA minors born abroad. There is no specific requirement that a PR card is required for a minor. (Even though adults would now require one in order to naturalise). Thank you so much for your response and for confirming that it's unclear :-). For a moment I thought...

EEA (PR) requirement for EEA child born abroad for MN1?

I am trying to get clarification on documents required for a minor (4 years old) EEA citizen for his MN1 application under section 3(1). This is in light of the changes that were introduced on 12/11/2015 in terms of requirement for AN applications only (requiring EEA PR for EEA citizens). I have unf...
