Re: Can I appeal? Can someone suggest a solicitor to help me

Once again thanks so much Noatjhan, I really appreciate your help. You are a star! :) Indeed when I first applied it was possible to apply direct for citizenship. So now I will make enquiries about sorting my PR status based on that pre 2006 section and see if it works. If not, I guess I have to wai...

Re: Can I appeal? Can someone suggest a solicitor to help me

There's 2 aspects to this: settled status and residence/absences. Obviously it still takes 5 years to acquire the holy grail of settled status. That's a given. But you mentioned failing on absence. Under 6(2), the residence requirement is 3 years so you should have applied this month to meet that r...

Re: Can I appeal? Can someone suggest a solicitor to help me

Its all about opportunity cost. So check out the AN guidance to see the requirements and rules you need to comply with. Then weigh up cost of compliance versus value of contracts/value of citizenship. And with benefit of British hubby you could/should have applied under 6(2) of BNA - 3 years reside...

Can I appeal? Can someone suggest a solicitor to help me?

Ok long story. Here is the deal. I am French, married to a British citizen. I have been in the Uk since 1997 ( almost 20 years! ) working most of the time. I, however, spent 15 months abroad between July 2011 and Sept 2013, when my husband was sent to Brazil for work reasons. I applied for citizensh...

Re: Application refused... will I need to pass exams again?

Hi Ohara, thanks again fro your posts. No I don't have PR yet. I will investigate and apply for it when I meet the requirements. My time line in the UK is as following: I arrived in April 1997 (with my now British husband). Worked in various places from Aug 1997 to May 2007 (as staff). We went trave...

Re: Unsuccessful Naturalisation (AN) applications

Thanks Ohara. It seems rules keep changing all the time :( So I can apply for the PR card in Oct 2017 then at end of 2018 for naturalization.... I was hoping to retire in 2017 with my husband and go travelling for a while. So we may have to revise our plans and keep my limited company going and cont...

Re: Application refused... will I need to pass exams again?

Hi, no I don't have the PR card. I guess now I need it before anything. It was not compulsory early last year when I first researched the process. SO the latest process seems to be PR card in October 2017 then citizenship one year later! :( That is a long wait. And it seems rather unfair considering...

Application refused... will I need to pass exams again?

Hi, As previously explained in another thread, my citizenship application was refused as I did not comply with 5 years EU Treaty rights requirements residency in the UK. My mistake, I spent time out of the UK between 2011 and 2012 (due to work commitments). I have been resident in the UK since 1997!...

Unsuccessful Naturalisation (AN) applications

Hi, my naturalization application has just been refused. :( Back ground: I am French, married to a British citizen since 2001. I have been resident in the UK since 1997. My husband worked in Brazil for 15 months between 2011 and 2012. So I spent time over there and did not work for 15 months. I don'...

Re: 3years or 5 years? French With BC husband.....

Thanks Noajthan for the link. I will fill the application with the border agency, as that might help. It is hard to prove I was working so far back in time, as many companies don’t keep records beyond 6 years. Anyway, working my way through all the places I worked in hope some may provide a certific...

Re: 3yeRs or 5 years? French With BC spouse.....

Vinny thanks you very much. What you say makes me feel better. I was absolutely crushed after my call to the Home Office and being told my application would be refused. I have contacted HMRC for various docs requested in the letter I receive from HO and I will try to gather as much info and docs as ...

Re: 3yeRs or 5 years? French With BC spouse.....

Hi everyone.... thank you very much for your comments. It is very helpful. I did get confused. I thought I was within the rules as spouse of a BC. I do not have a PR or anything like that. When I arrived in 1997, there was no concept of any card or anything. I did not even had to change my driving l...

3yeRs or 5 years? French With BC spouse.....

Hi, i applied in October for citizenship. I am french but my application is not based on EU treaty rights, because despite being here since 1997, i spent 15 months in Brazil for my husband work. Came back Oct 2012, exactly three years to my application. My husband is british citizen. I applied as sp...
