Will these rules definitely come in effect if the UK stays? Is the legality of the deal still being questioned or will all non-Eu marriages officially be classified as a sham after they vote to stay?

I think so. However, you may be snookered by the implementation of 'before marrying a Union citizen'. That would be the dumbest thing ever. You should wait for expert opinions but maybe I can give you an idea. I was married to my husband for only 3 months but we lived together longer than you have when I was issued a permit. One more question: Apparently Americans don't need a visa for Ireland? Couldn't I just fly as a tourist to join my husband once he settles in then apply for a residence card or would that cause trouble with immigration?

After researching I understand I need a short term C visa
My only questions now are:

Do I need medical/travel insurance?
Once I receive the visa how much time do I have to arrive in Ireland? I know once I arrive it is valid for 3 months.

We haven't found a flat yet so I highly doubt we would be able to apply for the RC in time and it would be a huge risk we aren't willing to make. I just don't understand why I wouldn't be allowed to exercise treaty rights if my EU spouse has never lived in the UK or EU.
