Great effort. Congrats!
Not sure why they made you to go through all this. So case workers need more training and there should be standard bench marks for similar cases.

Re: ILR Post vs PEO

@Sifanee
Did you submit you accounts through your accountant or self?
If it is accountant mistake, then you can force him to accept the blame. He will lose his license for any false advice.

Re: ILR Refused @ PEO - LTD Company Director

@ Ron101 All the best Ron. Each case is different, so sometimes you might get ILR approval. Not sure if leaving or remaining will make any difference to HO rules for now. It might take many years. But lots of cases I have seen here seem to be deception due to not paying tax on the income they earned...

Re: Urgent help Tier 1 General ILR

As Vinny said get a letter from accountant saying that 1.He made mistake in calculating the tax 2.He found out the error at later time during Audit 3.He takes full responsibility for that and ready to pay fine or lose his accounting license if proved wrong. This will ensure you won't be blamed for d...

@iWorker
He has declared the benefits as part of income for 41k.
If you show an income to HO for points all that income is taxable.
Otherwise it is a deception.

Re: ILR urgent query !!!

All benefits earned are taxable in UK. May be you can explain this offshore relations to HMRC and pay the tax due on the benefits and apply for ILR.
Salary shown for HO should reflect in HMRC returns, otherwise ILR will be rejected as deception.

Re: ILR refused 322(5) please help with advice

No one can predict it.
Best option would be to build a clear case with all the documents in order and go through a good lawyer.
It all depends on how you can convince them it was a genuine error.

You signed off the accounts so you alone have the responsibility of ensuring they are correct. See this Tribunal decision: https://tribunalsdecisions.service.gov.uk/utiac/ia-04731-2014 this is unreported case but you may also like to read this one https://tribunalsdecisions.service.gov.uk/utiac/ia-...

Tough case. Case workers take all Tax amendments seriously and consider it as a deception.
You have to go though a solicitor.

Re: LETS HAVE A PANEL OF BARRISTERS AND CHARTERED ACCOUNTANT

They are branding us as "terrorist". This should be another reason to file a defamation case against HO. How can amending tax be a threat to national security? I think any Tax deception can come under money laundering investigation. Money Laundering is an area for all kind of criminal act...

Every working individual has to play NI. People use a loop hole by taking money as dividends and taking less salary before the NI threshold and avoid paying NI. This is deception

People who use PSC companies as a sole director and take money as dividends, avoid paying NI.
Paying NI is important and not paying is a deception which is a reason for ILR refusal.

Yours is a tough case, if you have not filed Tax returns in that financial years. Don't believe accountants, they don't know anything about immigration matters. Go through a solicitor.
