Re: Past-Deception-effect on ILR

Thank you, you are right, these rules don't specify 10 years ban. But I don't know what below guidance is based on but it clearly states that Application for Leave to Remain will be refused where deception was used in previous application. This is really conflicting to rules. Be aware that the Rule...

Re: Past-Deception-effect on ILR

Just came across this which has confused me as previously it was referring to only Leave to Enter and for Entry Clearance, not Leave to Remain but below also includes Leave to Remain. What the rules require The Immigration Rules define fraud and forgery as a form of deception. If a person submits a ...

Re: Past-Deception-effect on ILR

Morning Vinny, Thank you for confirming this so specifically to my case 320(7B) is not applicable because: 1-I am not applying for Leave to Enter or Entry Clearance 2-They had full knowledge of my deception, I ticked Yes to deception still got visa. 3-I never left UK as managed to regularize my stay...

Re: Past-Deception-effect on ILR

Vinny, Thank you for clarifying on this and once again helping here. Please could you share your views on below couple of points: 1-As I declared deception, ticked Yes, Home Office still granted visa, is 320 (7B) removed and no longer applies to me according to below? Paragraph 320(7B) does not appl...

Dear Moderators and members, I hope you can help in this very difficult time of life. I desperately need your views, advice. I was refused on deception in 2010 . Re: Past-Deception-effect on ILR

Monty Court case was dismissed so deception was not removed. HO refused on the basis of deception in the past and then started granting visas so does it mean deception is removed? If so how? If not why not? Should there not be expectation for ILR after getting all those visas and thinking deception ...

Re: Past-Deception-effect on ILR

Hello Dancingguy,

Big Congratulations and thank you for sharing.

How did you came across deception?

Was it Entrepreneur extension application? Or ILR based on long residence?

Please could you share some details as you have been very lucky to get this even though you also have deception.

Re: ILR reapplication after refusal - can I still use PEO?

Hi, I've been trying to find an accurate answer for this situation as neither the HO nor my lawyer seem to agree on this. My husband (Tier 2 general) and I (PBS dependant) applied for ILR on the 26th September using PEO (Liverpool Premium Service centre). We had previously applied via postgal route...

Re: ILR refused even tax amended

Were you accused of deception because of tax issues?

If so, when you amend, will you be able to clear your name for ILR and British Passport?
