just send your application a month later that will cover all the arrival and departure days they will not refuse your application if you apply late ! i applied 2 week after my time was completed just so there will be no complication. anyway members on this form waiting 18 months to 2 years and still...

in second stage they say they will establish legal residence and good character
so the answer is no being in s second stage do not exempt anyone from the 6 weeks rule.

sorry I misunderstood the citizenship office email u posted I think they are saying if your out of six weeks or more deduct the whole period from the residency calculator

however I stand on my absence in previous year comment.

its pretty clear in their reply emergencies are out side the scope of 6 weeks count but you have to provide details on your application and they may ask you for proof for medical bills an such any unnecessary period spent out side state over six weeks should be deducted from the residency calculator...

put application date in the calculator it will them tell you from when the days can be accounted for, I think years of residence past 8 years cant be counted but check the residency calculator also last year residence should be continuous stamps and or physical residence so make sure no more then 6 ...

if those 10 weeks are consecutive and within the 12 month prior to your application date then that whole year could be disputed by doj unless you have good explanation such as work related or medical issues if the 10 weeks are in the course of past new years then no issue you should ask citizenship ...

if the citizenship provide information about every single possibility in every case the explanatory leaflet would be 200 pages long and that would overly complicate the application hence they provide examples of most reoccurring cases. they are not overly strict they are very clear on that 1 year prior to application residence must be continuous in term of stamps (for non eu) and physically residence so yea her application was ineligible in 2017. regarding if this applies to eu fam holider it definitely is in fact in my experience...

if your applying for eu1 then why the INIS is interested in the history its not eu3 application
all you need is an EU citz economically active living with non eu citz proof of address all the history is invalid in this case

if they deny on review that means they have solid ground to establish your application is ineligible.
a fresh application will also result in refusal unless circumstances are substantially changed.
if your solicitor is claiming that the decision was unlawful your best bet is to stick with that.
