Re: EEA FM refused again: HO doesnt receive or look at evide

You said you provided a letter issued by your university. Does it say you are enrolled as a PHD student etc? Is that your only occupation in the UK? If so, *I think* you need comprehensive sickness insurance in order to be a qualified person. Can anyone correct me if I'm wrong? [...] Maybe your wif...

Re: FP refused! HO ignored and not reviewed submitted docume

2- appeal (the appeal is handed over to a judge, who is most probably less stupid than the HO......) but it takes time... yes... How much time would you say on average? Am I right in thinking that one would surely get justice in the end through this process because it is more thorough? Sorry to say...

Re: EEA FM refused again: HO doesnt receive or look at evide

Thanks for your input mpmp16. Where is your husband at the moment (from which country is he applying)? Do you think we might have actually gotten the exact same caseworker on our applications, so it could have been just bad luck with the caseworker? Because even for those documents that did arrive h...

Re: EEA FM refused again: HO doesnt receive or look at evide

It seems like there are two problems that compound each other: the Chinese application centre is too incompetent to transfer all the documents we provide to the HO, and the ECO at the HO is very harsh (i.e. completely unfair) plus he doesn't get to see all of the documents. I don't think they are ac...

EEA FM refused again: HO doesnt receive or look at evidence!

Hello everyone! we really need your help, we are getting desparate. I'm a German doing a PhD in Britain and married to a Chinese. She applied for the EEA FM shortly after we got married but this got refused, partly because they did not receive my German passport as in the Chinese application centre ...

Re: Marry her so she can stay?

Thanks for the good advice! Turns out that during the appointment in China that my partner was attending, the woman there gave BACK the certified copy of my passport to my partner saying that she verified it. Also, my partner asked whether she should provide chatlogs, and got a "No thats fine&q...

Re: Marry her so she can stay?

Oh and how to go about providing evidence that the relationship is genuine? Photos from each month, dated in some believable fashion? Chat logs with mutual "I love you" confessions? Statement from my mother's landlord that we stayed at my mother's place for the Germany trip? Confirmation f...

Re: Marry her so she can stay?

Hey, thanks for your input guys. I wanted to give you an update on what happened so far. We got married in Las Vegas on 15.01. and obtained the certified copy of the marriage certificate. A few days after that, my partner went back to China, and I went back to London. Her boss agreed that immigratio...

Re: Marry her so she can stay?

Don't even go there. It could still be deemed frivolous/vexatious in the context of your case. Thanks, probably a safe advice. Although it seems like a very punishing law if your very first Visa application in the form of a T4 DES where every document is provided except one can be misrepresented as...

Re: Marry her so she can stay?

Thanks people for everything so far. It seems that for the family route, there are three options for us now. Correct me if I am wrong about anything, especially if any of those routes won't work, or if there are other options, please tell me. Option 1: Marriage in the UK She applies for EEA EFM, or ...

Re: Marry her so she can stay?

Why has your partner applied for a Tier 4 DES which from the information you've given she obviously doesn't qualify for. :?: She did not yet apply for the T4 DES. It Is not really obvious that she does not qualify for it since she was funded by both the UK university and China Scholarship Council, ...

Re: Marry her so she can stay?

So we went to an immigration lawyer, that advised us to do a delay tactic. Send in an EEA EFM or the T4 DES application a few days before the 17th and come to the marriage appointment on the 18th with a proof of having applied for a Visa. The processing of this application then likely takes longer t...

Re: Marry her so she can stay?

Your post is unclear. 1. Which Government website did you register on? 2. The fees to marry aren't 'hefty'. How much did you pay? 3. Do you believe the marriage ceremony will take place on the 17th Jan or is this an appointment to register your intent to marry? 1. Newham is our borough, therefore w...

Re: Marry her so she can stay?

One question. If your girlfriend's visa expires on the 17/01 and the marriage is taking place on 18/01, did the Registrar ask to see your passports. :? We booked an appointment online over a Government website (and paid a hefty fee) and had to put our nationalities, but nothing more immigration rel...

Re: Marry her so she can stay?

Thanks people! We booked an appointment at the local registry office on the 18.01. for the marriage, however the Visa expires on 17.01. What steps should we take next? Can we already start with the Family Visa application before the 18.01., or at least prepare for it? And what about Comprehensive Si...

Marry her so she can stay?

Hello all, I am a German PhD student (scholarship with 15.7k Pound annually), living in London since 09/15. Met my partner in 12/15, who is Chinese and now finished her CSC-funded PhD (Tier 4 Study Visa I think), and this Visa runs out mid 01/17. After trying for months, we are stressed and desperat...
