My couple of friends experienced similar situation within the last 3 years. They both tried to negotiate their notice period with their original company to match the start date of the new company (the date on the CoS). However they weren't allowed to leave earlier. I am just wondering if there are any updates to your situation? I am about to apply for a Tier 2 to change jobs, and I am bit worried after seeing that refusal can cause some confusions.
