Honestly, I'd just go with the best immigration lawyer you can afford. I'm sure they'll know about all the cases in which it can be shown to be a marriage of convenience and all the legal ramifications pertaining to yourself. I wouldn't take any chances with that, go with a professional in the law. ...

I agree, and it is unfortunate that para 255B of the Immigration Rules does not help the OP. What exactly did paragrah 255B state? Cuz as of 30th April 2006, here's what's changed: 4. Paragraphs 255 to 255B are deleted but this is subject to the transitional provision in paragraph 5. 5. Paragraphs ...

See now that's a bit troubling that your wife didn't get an ILR even though she applied for one. Cuz I'd be in the same boat as your wife. Did she have a right to reside permit and lived in the UK for 4/5 years prior to her ILR application? I had a family permit for 1 year (in 2002) and have had the...

EEA Partner Exercising Treaty Rights - Clarification Needed

I'm a non-EEA national married to an EEA national. I'm looking to apply for ILR (form EEA4) and it states that my EEA partner needs to demonstrate that they have been exercising treaty rights in the UK for 5 (consecutive - I've been told ) years. The form lists valid categories: • Worker • Self-empl...

JAJ is correct. Your husband qualifies as self-sufficient because you work. Here's what Chapter 1 Section 5 says: ...an EEA national will qualify [as exercising treaty rights] on the basis of self-sufficiency if his/her spouse, civil partner, or partner is able to support him/her financially through...

Yes, we have been unemployed. I do think that's the main reason as well. Gino, could you provide us with info on the length of your spouse's unemployment. Basically the law is that she needs to be in employment for a consecutive 5 years without meaningful breaks (eg unemployment or in school/uni wi...

Hi I just wanted to shed some light in what I've found in my research into the matter (I'm in a similar situation): The length of marriage and residence in the UK rule only applies to divorced couples or (I'm assuming) couples who have initiated divorce. As per section 6.1 of Chapter 2: Retention of...
