Suppose a refusal for ILR comes ON THE DAY my current leave

What is taking the HO so long with my ILR (0) Application?

My solicitor sent it in on the 21 February and it is now 2 April and yet, no news. Wonder what could be the hold up?

If I'm on a perm. contract, is HR obligated to extend visa?

I'm due to have my work visa extended one last time before qualifying for ILR. However, I am on a permanent contract. Because of this, is my boss obligated to try and renew my visa or can he say, I'm not going to renew your visa and that is that. If this was the case, would this be unfair dismisal. ...

I think we'll be ok (those of us who are already in the country). I can see the lawsuits now if they change the rules retrospectively. I just wonder what they mean though and how they are going to do it. Surely everyone (Tier 1 and 2) are meant to be temporary at first. Maybe they mean the ICT and r...

I don't think they'll scrap ILR. It will make it harder to achieve though. I think they'll be a tough points system at the end of the 5 (or if they decide to up the years to qualify) Either that or they can make Tier 2 extensions subject to advertising rules, like they did in the 80s and 90s. Who wo...

I don't think citizenship will be capped. My solicitor doesn't seem to think so although he said it would probably be some type of probationary citizenship (a tough points system perhaps).

I doubt that a cap on settlement will be put in place because that would cause more damage than is worth. For instance, NO BODY would move here because there would be no guarantees. Who would give up a good paying job to move here if nothing was certain. BUT you can expect some other changes. For ex...

Well is it likely that Damian Green and THresa May would implement a cap on citizenship? If they did, would it be as severe as the Migrant Watch wants? What do you think? I'm due to ILR in either January or June. If they do anything, do you suppose transitional arrangements would be in place?

But didn't the Tories provide transitiona arrangements for people who are on Tier 1 and two regarding the temp cap. Extensions weren't capped there. Just incoming people.

If they merge the labour market test with the shortage skills list, then that would definately cut down on the number of people coming into the UK. That would mean, companies could not bring in anyone unless it was on the shorage list AND it had been advertised.

well, see that is what they are wanting to do with Tier 2, restricting it to shortage occupations only and THEN before a non EU can take up the post, it must be advertised. At the present, if a job is on the shortage occupations list, it does not have to go through the labour market test. I could se...

Read this as it explains that damian green thought they should look at students and routes that allow people to remain permanately in the UK. So what could they do to make it harder to settle. Do you see them CAPPING ILR?

Yes but Damian Green told people that they were looking at all routes, including routes of settlement. So, what could be done regarding settlment. Do you think they will cap the NUMBER OF PEOPLE WHO WISH TO STAY ON AFTER EXTENSION?

well, if they are going to cap extensions, then what next? I heard Damian Green say that they were going to be looking at ALL routes, includes routes to settlement. Does that mean they are going to CAP settlement or just make people go through Probationary Citizenship? What is the deal with Probatio...

I just have to ask this. I have gone to bed...

MJnair,

You will need a new certificate of sponsorship but the UK Border Agency website said when they announced Tier 2 limits that priority would be given for extensions. You should be ok.

To cut 60,000 p.a., that is 15,000 per quarter. For 2010 quarter 1, tier 1 is 1930, tier 2 general is 2,735, tier 2 ict is 7,305, tier 1 dependents is 2540, and tier 2 dependents is 5315. Assuming tier 2 ict is not capped, stopping ALL new tier 1, tier 2 general and dependents together only gives 12...
