Ok all.... let me give the outline and what finally worked for him You can work 9 months in the UK, and go to home country to pick up a contract for the remaining 3 months. Come back to the UK and then apply. The UK earnings will not have any uplift obviously, but as you were physically in the home ...

No ... he definitely wasnt in his home country as he was working here in the UK during the 12-month's period. What is baffling then is why did the Points Based Calculator apply the uplift ratios even though the 2 types of earnings were for exactly the same period? I suppose if the PBC had told him t...

Thanks for your input. I had read this as well as section 133 of the same guidance before coming online. The issue is that the work that generated the self employed earnings were physically undertaken in the home country not in the UK and the guy even had to go home to carry out some of the work's r...

Tier 1 Refusal - Earnings issue - No uplift ratio?

Hi all, I am looking for advice for a colleague. He was initially granted T1 PSW visa from 27 Jan 2009 to 27 Jan 2011 and applied to switch into T1 General but was refused. He needs to earn 50k but seeing that he couldnt get that, he started a self employment in home country whilst also earning in t...

As already informed by John.... your wife can not apply with you as a family now unless you wait for her to complete her own 5 years. I am in the same scenario as you and can confirm that there is no shortcut other than this 1) Get your own naturalisation (after passing the citizenship test) 2) Once...

If all other requirements for ILR has been met, then you can indeed apply for ILR around 11 January 2010 (28 days before your initial date of entry). What is important is for the HO to receive your application with a valid visa at the date of application, it doesnt have to cover you up to 07 Feb 201...

Hi Sherlypk,

You can apply for your ILR with your son without a dependant visa.

As you said, there was no reason to apply for a dependant visa if the child never travelled out of the UK.

This scenario has been discussed many times in the forum.

All the best

Couple of questions to the OP.... If you came into the UK in October 2008, how can you show payslip for August 2008? You didnt say what you are applying for? I presume (as most others will I believe) that you want to change from WP to Tier 1 (General). If so then in this case, I will suggest you put...

Hi all, I got a colleague (an african with dependants) who will like advice on how to go about an appeal for a Tier 1 extension (from HSMP) removal in which the main problem is submitting an online bank statement for the last month of the 12 months period as the bank statements didnt arrive in time....

You will need to plan it yourself as it all depends on the length of visa you have. If you have a visa for 2 years and will be studying full time for 1 year, you will have just the remaining 1 year to make up for extension. If however you have 3 years and will be studying for 1 year, you have 2 year...

Spouse visa, ILR, Naturalisation - Domestic Violence

Hello, I have a friend who needs help and I can not really answer her at the moment, so I am asking here in the forum. Situation is as below; She got married in her home country to a British Citizen (also same national as her). She was then issued a Spouse visa Entry clearance: 08 Nov 2004 to 08 Nov...

I will advice the following... Send an email to Tier 1 Contact Centre and make enquiries specifically requesting that you need to have over 1 year leave remaining on your Tier 1 as employers are frowning at the fact that you have only 1 year left. Let them know you dont mind paying but need to confi...

As long as the baby is not going out of the country, you do not need to worry about getting the baby a visa right now. You can wait till you are ready to apply and then apply for your whole family at once (thereby saving much needed money). If however, your baby is travelling before you are applying...

As such I have decided to take the advantage of the points I can get now (due to age and current gross salary), and I will apply by September for Tier 1. I am hoping that...
