My brasilian partner just got his permanent residency application approved by HO (EEA4) we provided them with an original of our French Pacs signed in the French Consulat in London in 2001. My partner had as well a bad immigration history, overstayed 7 years.

i believe the application take so long because my partner has overstayed even if we have lived togther 5 years and we got french civil partnership registered in 2001. I have treaty right and been in the uk since 1996.

It is exactly what have been told by solicitors. You dont need to go back to your country even if u are overstayer, you can apply for residence card in hte uk and apparently under EU law if your partner exercise her treaty right HO cannot refuse your application. My solicitor has written another letter to HO. Hope we will get result. if not i will ask solvit.

Since the new EU regulation(30/06/2006) it should be easier for u to get residency.
If you were maried I think HO would grant u the right to stay with your EU partner even if u overstayed.
But I think the rules are different for unmaried patner that overstayed.

I am still waiting too. Application sent in May.
Next week if nothing has arrived I will contact Solvit asking them to take our case.

We applied in May 2006 and still waiting HO answer!!! We are in the same situation. The only difference is my partner overstayed. We apply for EEA3/EEA4 even with the overstay history they still should answer within 6 months apparently.

EEA applications

We applied in May 2006 for EEA4 & EEA3 permanent residency.
Still waiting for HO answer even if they should have given their answer within 6months of application.
Anybody in the same case?
Any suggestions?
