I would suggest you wait till Jan 2016 when the 3yrs has lapsed. At least you would have fulfill that requirement of waiting until 3yrs has lapsed. If you apply now and declare the conviction, HO might reject your application thereby wasting 1K and maybe banned for another 10yrs or they can hold on ...

Anyone with non-custodial convictions?

Hi, Is there anyone with non-custodial convictions and has recently applied for BC or looking to apply soon? Please share your experience. Got a DR10 conviction in Aug 10th 2012 and hoping to apply come this Aug 2015 since it will be 3yrs has lapsed from date of conviction with no other convictions.

As other comments said....you have to wait till sept 2015 before you can apply as that is when the 3yrs will lapse...and also make sure you declare the offence on the application as well. The rules have changed since you last apply for your FLR.......so you are better of waiting for few months to ap...

Yes its the only offence.

So when does it became unspent and will I be able to apply in Aug 2015 as per the new rules and the offenders act is exempted for immigration purposes.

My question now is

1. Can I apply when the 3 yrs as elapsed (new rules)
2. Wait after 5yrs (old rules)?

Thanks for ur reply, I know the driving ban starts from the day you got convicted but that wasn't the question.

Was asking if the 3yrs period as per new home office rules you had to wait before apply for naturalisation. Did you start counting from the date of conviction or date your ban ended?

Yea, think I will just leave it like that. Had 2 previous schengen visa 3,6 months in the last 12 months from the French embassy, so hopefully they will see that and give me a longer visa this time around and since I'm a permanent resident with Indefinite leave to remain.

Hi, thanks for your reply. Thing is, on the form, you can only specify either single or multiple entry, it doesn't give you the option to choose 3,6 months or 1-2 years visa.

Guess I will have to write 1-2 years in front when I tick multiple entry.
