I assume you are also aware that living together in the UK is not valid when appying for unmarried partners. After you get married, just head over to the British Embassy with the marriage certificate, letter of employment of your Dutch spouse, both your passports and passport-sized photographs and apply for the EEA family permit ... free of charge!

JAJ, magata had only questioned about the necessity of the Life in the UK test for obtaining the PR. Its obvious from the FAQ link from the HO that the test is necessary were she to go on and get naturalised as a British Citizen.

I believe that the information given by the HO is wrong and I still donot think that you have to give the test as you, inspite of being non-EEA are still going through the EEA route. Pls see Question 11 on this FAQs. EEA nationals in the question is not applied to EEA national but to non-EEA family ...

Being an EEA applicant, your mother doesnot have to pass the Life in UK test to apply for your PR. Were you all (you, your brother and your sister) furnished with the EEA residence permit back in March 2001?

Jeevan, I was under the impression that it is the SET(O) that should be used in such situations,i.e- when you apply for ILR. Are you sure that you used the FLR(O) and not SET(O)?

Limey, I do not think that your wife has to even apply for the EEA family permit! She can straight away apply for the Residence Card issued to the non-EEA family member of an EEA national using your Irish Passport without having to go China.

John, sorry but the more I look at it, the more I am inclined to go back to my original understanding of the Regulations. You must be divorced or have initiated the divorce proceedings to " retain " your right of residence. The 3 years of subsisting marriage is looked into only in the case...

Your wife cannot apply for ILR. But she can apply for her PR(Permanent Residence) though! Confused? I thought so. Let me explain. If you are to apply for her ILR through the UK immigration rules, she could be rejected as you dont cohabit/reside together anymore. But if you were to take the EEA route...
