You have to be physically present in the Uk 5 yrs bf your application. There is no discretion for this requirement. It is best you wait till February.

Don't get why it is an issue. He is your accountant and has known you for 6 years, his profession is on the list. Why should you put him down as family friend?
If you had used NCS/JCPA his reference would have covered the 2 applications. What he is saying does not make sense.

You can apply for 2nd child without a passport or nationality documents as child was born here.
